CULTURAL AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF MONGOLIA

The Government of the Republic of the Philippines and the Government of Mongolia hereinafter referred to as the High Contracting Parties.

Desirous of strengthening the friendly relations between the two countries and of promoting and developing exchanges in the fields of culture, arts, education, and sports have agreed as follows:

ARTICLE I

The High Contracting Parties agree to promote the development of mutually beneficial relations in the fields of culture, arts, education, and sports on the basis of mutual respect for sovereignty and in conformity with the laws and regulations in each country, bearing in mind the interests of their respective peoples.

ARTICLE II

The High Contracting Parties, subject to their respective laws and regulations, shall endeavor to accord to each other every facility to increase mutual understanding and exchanges in the fields of culture, arts, education, and sports.

ARTICLE III

The High Contracting Parties shall promote cooperation in the fields of culture, arts, and education through reciprocal visits, training programs, scholarships, and research exchanges and strive to provide appropriate facilities towards this end, for artists, scholars, cultural experts, educators, researchers, and university students.

ARTICLE IV

The High Contracting Parties agree to promote exchanges in sports and physical education through the holding of athletic competitions on the basis of reciprocity.

ARTICLE V

The High Contracting Parties agree, on the basis of reciprocity and subject to their respective laws and regulations, to adopt necessary measures for the protection in their respective territories of the literary and artistic properties of each other, including antiquities and other important cultural properties.

ARTICLE VI

The High Contracting Parties agree that the Department of Foreign Affairs of the Republic of the Philippines and the Ministry of Foreign Affairs of Mongolia will, through diplomatic channels, consult on details for the implementation of the present Agreement and work out programs of cultural exchanges.

ARTICLE VII

Either High Contracting Party may request in writing, through diplomatic channels, a revision or amendment of all or parts of this Agreement. Any revision or amendment mutually agreed upon shall enter into force in accordance with Article VIII.

ARTICLE VIII

The present Agreement shall enter into force on the date of the last notification by which the High Contracting Parties inform each other, through diplomatic channels, that their respective domestic requirements for giving effect to the present Agreement have been fulfilled. It shall be valid for a period of three (3) years, renewable automatically for successive periods of three (3) years unless either of the High Contracting Parties requests its termination by serving a written notice to the other Party six (6) months prior to the next date of termination.

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement in Manila on 01 Sept. 2000 in two originals, both written in English.

PROTOCOL OF NEGOTIATIONS

1. Being duly authorized by their respective Governments, delegations from the Republic of the Philippines and from Mongolia met in Manila on 28 August 2000 for the purpose of negotiating a Cultural Agreement. The lists of, both delegations are attached hereto and marked as Annex "A".

2. The meeting was held in a friendly and cordial atmosphere and both Parties agreed to initial the Cultural Agreement between the Government of the Republic of the Philippines and the Government of Mongolia.

3. The initialed text of the Cultural Agreement Between the Government of the Republic of the Philippines and the Government of Mongolia is attached hereto as Annex "B".

It was also agreed that Article 8 on Validity and Entry into Force shall mean that the Cultural Agreement Between the Government of the Republic of the Philippines and the Government of Mongolia shall enter into force on the date of the later notification by the Contracting Parties, through diplomatic channels, indicating compliance with their respective domestic requirements for its entry into force.

Done in Manila on the 28th day of August 2000.
