MEMORANDUM OF UNDERSTANDING ON HEALTH WORKERS' DEVELOPMENT COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE KINGDOM OF CAMBODIA

The Government of the Republic of the Philippines, represented herein by the Department of Health and the Government of the Kingdom of Cambodia, represented herein by the Ministry of Health, hereinafter referred to as the "Contracting Parties",

Desiring to strengthen the existing friendly relations between the two countries through cooperation in health development;

Hereby agree to pursue joint undertakings and exchanges in the field of health development through this Memorandum of Understanding (hereinafter referred to as "Memorandum") to be implemented as follows:

ARTICLE 1

This Memorandum is one of collaboration between the two Parties in pursuing health workers' development in Cambodia:

Specifically, both Parties agree to the following provisions:

1. Develop a mechanism by which both Parties will participate in the formulation and implementation of a health workers' development plan for Cambodia.

The Philippines shall:

2. Provide technical assistance in the actual implementation and training of the health workers of Cambodia in consonance with the above mentioned plan.

3. Provide short term consultants to follow-up or supervise the implementation of the plan.

The two Parties shall encourage their implementing authorities to coordinate in the above-mentioned activities in accordance with the rules and regulations in force in each country.

ARTICLE 2

This Memorandum will commence upon final negotiation by both Parties as to the exact details of the Memorandum. Likewise, it shall commence upon the availability of funds for the project.

This Memorandum may be modified or amended by written agreement between the two Parties or may be terminated by either Party six (6) months prior by written notification to the other Party.

ARTICLE 3

Any dispute arising out of the implementation of this Memorandum shall be settled through negotiation between the two Parties.

ARTICLE 4

This Memorandum shall enter into force on the date of the later notification by either Party, through diplomatic channels, indicating compliance with their respective domestic requirements for its entry into force.

This Memorandum shall remain in force for five (5) years, unless terminated by either Party upon six-month written notice to the other Party. It may be modified or extended through written confirmation of both Parties. In the event of the termination of this Memorandum, the Parties shall consult with each other regarding the completion of the activities underway.

IN WITNESS WHEREOF, the undersigned, duly authorized by their respective Governments, have signed this Memorandum.

DONE in Manila, Philippines, on this sixteenth day of August, the year 2000, in two original texts, in the English and in the Khmer languages, both texts being equally authentic. If there is any divergence concerning the interpretation of this Memorandum, the English text shall prevail.
