RESOLUTION NO. 1 OF THE JOINT INDONESIAN-PHILIPPINE COMMISSION ON SEA COMMUNICATION

 WHEREAS, the promotion and encouragement of maritime commerce between the Republic of Indonesia and the Republic of the Philippines is necessary to stimulate the economic development of both countries;

WHEREAS, a reciprocal maritime services arrangement is mutually desirable and advantageous for maritime commerce of both countries;

BE IT RESOLVED, therefore, that the Republic of Indonesia and the Republic of the Philippines hereby agree and covenant:

(1) Subject to their applicable laws, rules and regulations, to grant such permits, papers and other documents as shall be necessary to insure prompt entry and dispatch of vessels from their respective ports.

(2) To refrain from imposing any unnecessary restrictions or undue discrimination on the use of their ports, harbors, and other shipping facilities as are necessary for the operation and maintenance of vessels.

(3) Subject to their applicable laws, rules and regulations, to accord equal treatment to the vessels of either Party in the imposition of fees, dues and such other charges as may be collected therefor.

(4) To accord in their respective territory full protection and security to all vessels operating under this arrangement; and shall not, except in accordance with the generally accepted principles of international law, conduct unreasonable searches and seizures of the vessels of either Party.

BE IT RESOLVED FURTHER, that the following rules are hereby adopted to implement the above arrangement:

(1) The privileges granted under this arrangement shall be available to the flag vessels of the Republic of Indonesia and the Republic of the Philippines.

(2) No vessel shall be allowed to operate under this arrangement unless qualified under the applicable laws, rules and regulations of either Party, as the case may be.

(3) Any Vessel desiring to operate under this arrangement shall register with the Joint Indonesian-Philippine Commission on Sea Communications.
