MARITIME TRANSPORT AGREEMENT BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE FEDERAL REPUBLIC OF GERMANY
Note: The Agreement entered Into force, March 3, 1964.
1. The Governments of the Republic of the Philippines and the Federal Republic of Germany agree to encourage the development of maritime transport between both countries in a spirit of friendship, and to remove any possible difficulties in this field.
2. The Federal Republic of Germany, subject to the constitutional and statutory provisions in force, accords to the shipping of the Republic of the Philippines:
a) a treatment which precludes any discrimination against the shipping of the Republic of the Philippines and which does not prejudice a choice of flag in accordance with the principles of free competition;
b) equality of treatment with its own vessels in its ports. This applies to customs formalities, the levying of charges and port dues, freedom of access to, and the use of, the ports, as well as to all facilities afforded to shipping and commercial operations in respect of vessels, their crews, passengers and cargoes. In particular, this refers to the allocation of berths at piers and loading and unloading facilities;
c) the possibility to use the proceeds accruing in the Federal Republic of Germany from services rendered, for the purpose of making payments in the Federal Republic of Germany or effecting transfers to other countries.
3. The Government of the Republic of the Philippines for its part, subject to constitutional and statutory provisions in force, undertakes to grant like rights to German shipping as long as those rights are accorded to its own shipping by the Federal Republic of Germany.
4. This Protocol shall also apply to Land Berlin, provided that the Government of the Federal Republic of Germany has hot made a contrary declaration to the Government of the Republic of the Philippines within three months from the entry into force of this Protocol.
5. This Protocol shall enter into force on the date of signature thereof.
DONE at Manila on this 3rd day of March, 1964, in four originals, two each in English and German languages, all four texts being equally authentic
