MEMORANDUM OF UNDERSTANDING

1. This Memorandum sets out the understanding reached between the Government of the Philippines and the Government of Singapore concerning the participation of the Republic of Singapore Air Force (RSAF) in Cope Thunder Exercise 87-2 from 5 to 20 December 1986.

2. The RSAF Detachment is considered a visiting friendly force to the Republic of the Philippines and will conform with normal diplomatic clearance procedures applicable to friendly visiting forces.

3. The Laws, Rules and Regulations of the Republic of the Philippines will govern the RSAF Detachment including supplies, equipment and personnel as regards its entry, stay, operations and activities in and departure from the Philippines, except as otherwise provided in this Understanding.

4. The Republic of the Philippines will have the right to exercise jurisdiction over all offenses committed in the Philippines by any member of the RSAF Detachment except as provided in this understanding.

5. The Philippine Air Force (PAF) through Clark Air Base Commander (CABCOM) will have control over- all activities of RSAF Detachment related to this exercise tasking accomplished through the Cope Thunder Scheduling and Operations Section.

6. All RSAF flights will adhere to establish Bureau of Air Transportation (BAT) Flight Rules, PAF Flying Regulations and locally established Flight Rules and Regulations of Clark Air Base.

7. The Republic of the Philippines hereby consents to the use of RSAF of the US facilities within Clark Air Base, pursuant to paragraph 2, Article II of the provisions of the RP-US Bases Agreement of 1947 as amended. For this purpose, the RSAF may make arrangements with USAF in Clark Air Base. Nothing in any such arrangements will be construed as authorizing any derogation, of any provisions of the MBA of 1947 as amended, or other related agreements. Any such arrangements between the RSAF and the USAF not covered by or within the purview of the MBA of 1947 as amended will be subject to approval of the Republic of the Philippines.

8. All local procurement of administrative personnel services, if any, supplies and equipment by RSAF Detachment will be undertaken in coordination with CABCOM.

9. Specific details governing visits by the RSAF to the Philippines will be as set out in Appendices 1 to 5 of this Document.

10. This understanding will take effect on 5 December 1986 and continue up to 15 days after the termination of the exercise.
