EXCHANGE OF NOTES FOR THE EXECUTION OF THE PROJECT TO BE KNOWN AS "INTERNATIONAL TRAINING IN RURAL EXTENSION PROJECTS IN THE PHILIPPINES"

The Ministry of Foreign Affairs presents its compliments to the Royal Netherlands Embassy and has the honor to refer to the Embassy's Note No. 3655 dated 5 November 1985 quoted as follows:

"The Royal Netherlands Embassy presents its compliments to the Ministry of Foreign Affairs of the Republic of the Philippines and has the honour to inform the Ministry that the Netherlands Minister for Development Cooperation is prepared to cooperate with the Philippine authorities with respect to the execution of a project to be known as "International Training in Rural Extension Projects in the Philippines (ITBEP)", hereinafter referred to as the project, as described in the project proposal of December, 1984.

The aim of the project is to create adequate training facilities for rural extension in the Philippines. To this end there shall be a close cooperation between the International Agricultural Centre (IAC) at Wageningen and the University of the Philippines at Los Baños.

Further project details, including the contributions of both the Netherlands Minister and the Philippine authority concerned, the National Economic Development Authority (NEDA), are being given in the aforementioned project-proposal.

Furthermore, the Embassy would like to bring to the attention of the Ministry that it is the understanding of the said Netherlands Minister that the Netherlands experts and the equipment to be used for the execution of the project, will be granted the following privileges, immunities and facilities;

a) exemption of payment of income-tax on salaries and emoluments paid by The Netherlands;

b) exemption from payment of customs duties on personal and household effects, including one motor vehicle, brought into the Philippines within six months of first arrival, subject to the following conditions:

1) gasoline engine displacement of motor vehicle shall not exceed 2800 cc; Kerbweight shall not exceed 1500 kilograms;

2) If used for less than 1 year from date of registration, motor vehicle must be re-exported;

3) If used for more than 1 year but less than 3 years from date of registration, motor vehicle may be sold only to a privileged person;

4) if used for more than 3 years from date of registration, motor vehicles may be sold to a non-privileged person subject to prior approval of the Ministry of Foreign Affairs and on condition that all taxes on the vehicle shall be paid;

c) the right of free movement whether within to or from the Philippines by the experts and their dependents;

d) the provisions free of charge of entry-visas, identity documents, and work-permits;

e) the most favourable exchange facilities for all remunerations received from the Netherlands;

f) indemnification by the University of the Philippines Los Baños (UPLB) of the Netherlands and the Netherlands experts against any liability arising from any act or omission made in the cause of the performance of the duties of the experts and causing the death or physical injury to a third party or damage to the property of a third party, unless such liability derives from wilful misconduct or from gross negligence on the part of the experts,

If the Philippine authorities have to deal with any claim under this provision, the authorities will be entitled to exercise all rights to which The Netherlands or the experts are entitled;

g) all equipment and materials supplied by The Netherlands for the project will be exempted from import and export duties or fiscal charges, including harbour fees. It remains the property of The Netherlands until the termination of The Netherlands contribution to the project.

The Embassy would appreciate the confirmation that the above is agreeable to the Ministry, and has the honour to propose that with the exchange of notes, the agreement will be finalized."

The Philippine Government agrees to the above quoted proposal regarding cooperation in the project to be known as "international training in rural extension projects," and that the Embassy's Note No. 3655 dated 5 November 1985 and this Note shall constitute an agreement between our two Governments, to take effect on the date of this Note.

The Ministry of Foreign Affairs takes this opportunity to renew to the Royal Netherlands Embassy the assurances of its highest consideration,
