AGREEMENT CONCERNING THE GRANT OF FOOD AID FOR THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES BY THE GOVERNMENT OF THE FRENCH REPUBLIC

The Government of the French Republic and the Government of the Republic of the Philippines have agreed on the following:

ARTICLE 1

The Government of the French Republic will deliver to the Government of the Republic of the Philippines two thousand (2.000) tons of wheat.

ARTICLE 2

The Government of the French Republic will undertake all preliminary operations concerning the delivery of this wheat which will be transported by its care and at its expenses up to the port of MANILA.

ARTICLE 3

The wheat will be in conformity with the "European quality standard". Its selling value for the application of the present agreement will be estimated at 850 French Francs per metric ton.

ARTICLE 4

The Government of the Republic of the Philippines will have the ownership of the goods being the subject of the present agreement from the loading on the transporting vessel. The loading will be reserved by priority to a French shipping and the insurance to a French company.

ARTICLE 5

In case this product is not distributed free of charge, the sale proceeds in the internal market of the Philippines will be deposited in a counterpart fund created by the Government of the Republic of the Philippines and will be assigned to financing of local expenses of development projects to be chosen by common agreement between the Government of the Philippines and the French Embassy in MANILA (Commercial Department).

ARTICLE 6

The Republic of the Philippines will take all necessary measures to avoid reexporting not only the product received but by-products and similar products also.

ARTICLE 7

The contracting parties will take the necessary measures to assure that these supplies furnished as food aid add to and do not substitute commercial dealings reasonably foreseen in the absence of such supplies.

ARTICLE 8

The present agreement will come into force as soon as consultation procedures -provided by resolutions 1/53 and 2/55 of the Food and Agriculture Organization- will have been accomplished. Its methods of application will be determined by an agreement between the National Interprofessional Office of Cereals (21, Avenue Bosquet - 75007 PARIS) and the Embassy of the Republic of the Philippines in Paris.

In witness thereof the undersigned, duly authorised for this purpose by their respective Governments, have signed this agreement and have affixed thereto their seal.
