MEMORANDUM OF UNDERSTANDING

1. This Memorandum sets out the understandings reached between the Government of the Philippines and the Government of Thailand concerning the participation of the Royal Thai Air Force (RTAF) in Cope Thunder Exercise 86-3.

2. The RTAF Detachment is considered a visiting friendly force to the Republic of the Philippines and will conform with normal diplomatic clearance procedures applicable to friendly visiting forces.

3. The Laws, Rules and Regulations of the Republic of the Philippines will govern the RTAF Detachment including supplies, equipment and personnel as regards its entry, stay, operations and activities in and departure from the Philippines, except as otherwise provided in this Understanding.

4. The Republic of the Philippines will have the right to exercise jurisdiction over all offenses committed in the Philippines by any member of the RTAF Detachment except as otherwise provided in this understanding.

5. The Philippine Air Force (PAF) through Clark Air Base Commander (CABCOM) will have control over all activities of RTAF Detachment related to this exercise, with exercise tasking accomplished through the Cope Thunder Scheduling and Operations Section.

6. All RTAF flights will adhere to established Bureau of Air Transportation (BAT) Flight Rules, PAF Flying Regulations and locally established Flight Rules and Regulations of Clark Air Base.

7. The Republic of the Philippines hereby consents to the use of RTAF of the US Facilities within Clark Air Base, pursuant to para 2, Article II of the provisions of the RP-US Military Bases Agreement of 1947 as amended. For this purpose, the RTAF may make arrangements with USAF in Clark Air Base. Nothing in any such arrangements will be construed as authorizing any derogation of any provisions of the MBA of 1947 as amended or other related agreements. Any such arrangements between the RTAF and the USAF not covered by or within the purview of the MBA of 1947 as amended will be subject to approval by the Republic of the Philippines.

8. All local procurement of administrative personnel services, if any, supplies and equipment by RTAF Detachment will be undertaken in coordination with CABCOM.

9. Specific details governing visits by the RTAF to the Philippines will be as set out in Appendices 1 to 5 to this Document.

10. This under standing will take effect on 02 January 1986 and continue up to 30 days after the termination of the exercise.
