THE FIRST SENIOR OFFICIALS MEETING ON THE DELIMITATION OF THE MARITIME BOUNDARY BETWEEN INDONESIA AND THE PHILIPPINES

Manado, 23-25 June 1994

RECORD OF DISCUSSION

1. The First Senior Officials Meeting on the Delimitation of the Maritime Boundary between Indonesia and the Philippines was held in Manado, from June 23 to June 25, 1994.

2. The Indonesian Delegation was led by H.E. Mr. Izhar Ibrahim, Director General for Political Affairs, Department of Foreign Affairs. The Philippine Delegation was led by Hon. Rodolfo Severino, Undersecretary for Policy, Department of Foreign Affairs. Attachment A contains the list of the members of the Indonesian Delegation and Attachment B contains the list of the members of the Philippine Delegation.

3. The two delegations made introductory remarks. Attachment C contains the statement of the Head of the Indonesian Delegation and Attachment D contains the statement of the Head of the Philippine Delegation.

4. The discussions were conducted in a friendly and cordial atmosphere in accordance with the ASEAN spirit of understanding and cooperation.

5. The Agenda of the Meeting was agreed upon and is reproduced as Attachment E. The Meeting agreed to discuss item 2 of the Agenda at the technical level. At the technical level, the Indonesian Delegation was led by Mr. Budiman Darmosutanto, Director for International Treaties, Department of Foreign Affairs. The Philippine Delegation was led by Ms.Minerva Jean A. Falcon, Assistant Secretary, Office of Legal Affairs, Department of Foreign Affairs.

6. Under item 2 (a), discussions on relevant principles of international law, the two Delegations proposed principles that should serve as the basis for negotiations of the delimitation of maritime boundaries. The Indonesian proposal is reproduced in Attachment F. The Philippine proposal is reproduced in Attachment G. The following principles were agreed upon :

a. The two Delegations agreed to strive for early and workable solutions acceptable to both countries' governments and peoples and in this regard, to achieve result fully in keeping with international law including the 1982 Convention on the Law of the Sea ;

b. The two Delegations agreed that, where applicable, the maritime boundaries between the two countries shall be delimited on the basis of the median line principle ;

c. The two Delegations, cognizant of the friendly and warm relationship between their governments and peoples agreed to use creative options as appropriate.

7. Under item 2 (b), the identification of area of delimitation on which to commence detailed negotiation, the Indonesian Delegation showed a map indicating the area of delimitation, Indonesia's baselines and a proposed line of delimitation. The map is reproduced as Attachment H.

The two Delegations agreed that the area to be delimited would cover a location between 120° and 129° 30' East Longitude. The area located between 120° and 125° E.L. was discussed initially at the present meeting. The area located between 125° and 129° 30' East Longitude shall be discussed at the next round of negotiations. The two Delegations also agreed that the area from 120° E.L. westward would be left pending for the time being.

8. The Indonesian and the Philippine Delegations made statements on item 2 (b) concerning the identification of area of delimitation on which to commence detailed negotiation. The Indonesian statement is reproduced as Attachment I. The Philippine statement is reproduced as Attachment J.

9. Under item 2(c), discussion on the mapping methodology, both Delegations agreed that the delimitation of the maritime boundary between the two countries shall be on the basis of common datum (WGS 84).

10. The next round of negotiation will be held in the Philippines at a mutually acceptable date.
