MEMORANDUM OF UNDERSTANDING RELATING TO THE ASSISTANCE TO NACIAD PROJECT IN THE REPUBLIC OF THE PHILIPPINES

         
                   
                                             
                                               
GENERAL
1.
THIS MEMORANDUM expresses the understandings of the Governments of the Republic of the Philippines and Australia concerning the responsibilities and contributions respectively of the two Governments in regard to the assistance to NACIAD Project located in Manila which is intended to assist the National Council on Integrated Area Development (NACIAD) in its collection, storage and analysis of data on existing and potential integrated area development projects as further described and detailed in Annex I to this Memorandum.
AUTHORITIES

The Executing Authorities for this Project will be:


For the Government of the Republic of the Philippines: The National Council on Integrated Area Development. For the Australian Government: The Australian Development Assistance Bureau of the Department of Foreign Affairs. The Australian Development Assistance Bureau may nominate suitably qualified agents to undertake any part of its functions on its behalf.
DURATION

This Memorandum will take effect from the date of its signature and the Project will be deemed to have commenced from that date. The Australian contribution to the Project and all undertakings given herein will cease one year after the date of signature of this Memorandum or on such other date as may subsequently be arranged between the two Governments.
RESPONSIBILITY

Responsibility for development and direction of the Project will be vested in a Project Co-ordinating Committee, which will have representatives from the Government of the Philippines and the Australian Embassy in Manila. Functions of the Project Co-ordinating Committee will include:


(a) co-ordinating policy for the Project.

(b) reviewing and reporting on progress to the two Governments.

Final responsibility for this project will rest with the Government of the Philippines.
CONTRIBUTIONS

The contributions of the Philippine and Australian Governments are detailed in Annex III and II and are estimated to value P1,350,000 and $A90,000 respectively. Disbursement of Australian contributions will be subject to the normal annual parliamentary approval of appropriations.
EVALUATION
7.
An evaluation of progress of the Project may be made at times arranged between, and mutually convenient to the Philippine and Australian Governments.
SUPPLIES
8.
(a) The Government of the Philippines will exempt from import duties and other taxes (or pay such duties thereon) all goods supplied by Australia for the established purposes of the project as set out in Annex I.
 
  (b) The Government of the Philippines will facilitate movement of project supplies by providing appropriate customs and wharfage facilities in the port closest to the project site and will be responsible for expeditious transport of such supplies to site.
 
(c) Project supplies provided by Australia shall be available for the unrestricted use of the Project.
CLAIMS
9.
Since assistance under this Memorandum of Understanding is provided for the benefit of the Government and people of the Republic of the Philippines, the Government of the Philippines will bear all risks arising from operations under this Memorandum of Understanding. The Government of the Philippines will deal with any claims which may be brought by third parties against the Australian Government its servants or Australian personnel, and will hold harmless the Australian Government and Australian personnel in case of any claims resulting from operations under the Memorandum of Understanding except where it is established in the course of mutual consultation and determination by the two Governments that such claims arise from gross negligence or willful misconduct of agents of the Australian Government or of Australian personnel.
SECURITY
10.
The Government of the Philippines will arrange for any protective services deemed necessary to ensure the safety of the person and property of Australian personnel, and of their dependants and Australian project supplies.
AMENDMENTS11.Amendments to this Memorandum may be made at any time by an exchange of letters between the signatories.

ANNEXURES to this Memorandum form an integral part of it.

ANNEX I

PROJECT DESCRIPTION

The National Council on Integrated Area Development (NACIAD) is the co-ordinating agency of the Government of the Philippines for implementing Integrated Area Development Projects in less developed regions of the Philippines. It is responsible for assessing possible locations for future IAD projects as well as monitoring and evaluating current and completed IAD projects. To perform these functions NACIAD is required to gather data on areas of the country for which data bases are either non-existent or contain suspect material. NACIAD staff are therefore required to collect and assemble the data bases, analyse the data and monitor change brought about by projects under their jurisdiction.

The project objectives are:

1. To increase NACIAD's data collection capacity by providing four four-wheel drive vehicles suitable for use by field data collection teams operating in remote areas;

2. to improve NACIAD's efficiency and effectiveness in data storage and analysis by providing a micro computer system suitable for use by NACIAD personnel. 

ANNEX II

AUSTRALIAN GOVERNMENT CONTRIBUTION

The Australian Government will provide:

1. Four (4) four wheel drive passenger vehicles;

2. a micro computer system meeting or exceeding the following specifications:

- 128 K memory;

- 20 M disk storage;

- floppy disk with at least an 8 inch diskette drive;

- three terminals each of at least 20 x 80 character format and at least ten programmable function keys;

- one line printer of 132 columns and 180 c.p.s.;

- one letter quality printer of 40 c.p.s.

  The Australian Government commitment to the project is a maximum of $90,000.

  ANNEX III

  PHILIPPINE GOVERNMENT CONTRIBUTION

The Philippine Government will provide:

1. Trained staff, supplies and facilities sufficient to maintain and operate the vehicles in accordance with the standards and specifications recommended by the vehicle's manufacturer;

2. suitable accommodation, trained staff, supplies and facilities required to maintain and operate the computer system in accordance with the standards and specification recommended by the computer system's manufacture.

The Philippine Government commitment to the project is a maximum of P1,350,000.
