SUPPLEMENTAL, AGREEMENT NO. 6 BETWEEN THE FOOD AND AGRICULTURE ORGANIZATION OF THE UNITED NATIONS AND THE GOVERNMENT OF THE PHILIPPINES FOR THE PROVISION OF TECHNICAL ASSISTANCE TO THE GOVERNMENT OF THE PHILIPPINES

The Food and Agriculture Organization of the United Nations (hereinafter called "the Organization") and the Government of the Philippines (hereinafter called "the Government") desire, subject to the necessary funds being available to the Organization, to implement the Basic Agreement for Technical Assistance concluded between them under date of 26 October 1950, the provisions of which are by reference made a part hereof.

Therefore, the Organization and the Government have entered into this Supplemental Agreement No. 6 through their undersigned duly authorized representatives.

ARTICLE I

TECHNICAL ASSISTANCE TO BE PROVIDED

The Organization shall, within the limits prescribed in the Basic Agreement, arrange for one forestry expert (hereinafter called "the expert") to visit the Phil-ilippines (hereinafter called "the Country"), as soon as all arrangements have been made, for the provision of the technical assistance described below:

(a) One (1) expert in forest legislation and policy for a period not exceeding twelve (12) months to advise and assist the Government in the drafting of forest laws, with particular regard to the present ownership of and concessions in the forests of the Country.

ARTICLE II

LIAISON

The Government designates the National Development Company as the central coordinating agency for the purpose of Article II of the Basic Agreement, and as the agency with which the Organization shall deal in connection with the Technical Assistance rendered under the Supplemental Agreement.

ARTICLE III

DETAILED ADMINISTRATIVE AND FINANCIAL OBLIGATIONS

1. The obligations of the Organization for costs shall be as set forth in Article III of the Basic Agreement.

2. The obligations of the Government for costs under Article II of the Basic Agreement, and as the agency with provisions:

(a) The Government shall provide for the expert at his Headquarters in the Country lodging of a standard in keeping with his professional and international status. In lieu of lodging the Government shall pay to the expert a daily lodging allowance equal to forty per cent (4096) of the full subsistence rate of Twenty-eight (28) pesos a day, the said rate having been set by the Technical Assistance Board for the Country. This provision shall continue notwithstanding any temporary absence of the expert from his Headquarters.

(b) The Government shall provide for the expert for the duration of any official travel in the Country away from his established headquarters, board and lodging of a kind in keeping with his professional and international status. In lieu of board and lodging, the Government shall reimburse the expert for the equal costs he incurs.

(c) Inasmuch as the Technical Assistance Board does, from time to time, review the subsistence rates it sets for various countries in the light of changing cost of living circumstances, the Organization and the Government agree that any change in the arrangements referred to in paragraphs (a) and (b) shall be the subject of mutual accord.

(d) The Organization shall be free of any liability arising from the use of transportation furnished by the Government for the official duties of the expert.

(e) The Government shall, in accordance with paragraph (c) of Article III of the Basic Agreement, establish a local currency fund for operation by the Resident Technical Assistance Representative for the defraying of local currency expenses under the requirements of this Supplementary Agreement. Upon completion of the project the balance remaining in the local currency fund will be returned to the Government.

(f) Before the arrival of the expert, the Government shall make such administrative and financial arrangements as are necessary for the prompt execution of the provisions of this Supplemental Agreement.

In Witness Whereof, the undersigned duly authorized representatives of the Organization and of the Government respectively, have on behalf of the parties, signed in Supplemental Agreement No. 6.
