PLANS OF OPERATION AGREEMENT BETWEEN THE WORLD HEALTH ORGANIZATION THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE JOHNS HOPKINS UNIVERSITY FOR ASSISTANCE TO THE INSTITUTE OF HYGIENE OF THE UNIVERSITY OF THE PHILIPPINES

Note: The Agreement entered into force July 16, 1953.

The World Health Organization (hereinafter referred to as "the Organization"); and

The Government of the Philippines (hereinafter referred to as "the Government"); and

The Johns Hopkins University;

Being desirous of obtaining mutual agreement concerning an education project, particularly with reference to the purpose of the project, and the responsibilities which shall be assumed by each of the parties, Declaring that these responsibilities shall be fulfilled in a spirit of friendly cooperation,

HAVE AGREED AS FOLLOWS:

PART I

Relationship Between the Government and the Organization The Basic Agreement concluded between the Government and the Organization signed on 5 April 1951 provides the basis for the relationships between the Government and the cooperating Agency in this project and the Articles of this Plan o£ Operations should be interpreted in the light of the basic agreement.

PART II

PLAN OF ACTION

1. Objective

To assist the University of the Philippines by giving further training to the faculty of the Institute of Hygiene.

2. Planning, Extent and Administration of the Project

2.1 A detailed plan for the administration of this project is annexed to this Agreement.

2.2 The project shall be conducted under the sole responsibility of the Government.

2.3 This Agreement when signed by the three participating parties shall indicate that all three parties agree to the arrangements and shall consider the Agreement as binding on the individual parties only in respect of those sections dealing with the individual parties concerned.

PART III

COMMITMENTS OF THE JOHNS HOPKINS UNIVERSITY

1. The University shall, over a two year period, provide a total of eight professors, four of whom shall be departmental heads and four of whom shall be assistant departmental heads. Two of each category shall be made available in each year. The departmental heads during the summers of 1953 and 1954 shall serve for a period not to exceed 3 months each, and the assistant departmental heads for the University of the Philippines academic year, i.e., August to April. The first group of assistant departmental heads shall'commence duties in August 1953 and the second in August 1954.

2. The University shall provide positions for the four University of the Philippines staff members as described in the Annex to this Agreement.

PART IV

COMMITMENTS OF THE ORGANIZATION

1.1 The Organization shall co-ordinate the assistance which shall be rendered to the University of the Philippines by the Johns Hopkins University.

1.2 The Organization agrees to provide under the expanded programme of Technical Assistance for Economic Development, the following personnel, equipment, supplies and fellowships, subject to the availability of funds.

1.3 Personnel

The Organization shall meet the cost of salaries, allowances (except lodging) and international travel for the four departmental heads. Further, the Organization shall meet the cost of international travel including travel of authorized dependents plus all allowances (except lodging) applicable to the four assistant departmental heads.

1.4 Equipment, Supplies and Literature

The Organization shall supply teaching equipment, supplies and literature, the value of which over a two year period shall not exceed $6,000.

1.5 Fellowships

The Organization shall award four fellowships over a two year period so as to enable faculty members of the University of the Philippines to study at the Johns Hopkins University. Reference to these fellowships is also made in Part III, 3, Part V, 1.1, and the Annex to this Agreement.

2. The ownership of the equipment and supplies mentioned in paragraph 1.4 of this Part shall be retained by the Organization unless or until it is transferred by the Organization to the Government in accordance with TAB regulations.

PART V

COMMITMENTS OF THE GOVERNMENT

1. The Government shall provide all personnel, materials, supplies and equipment necessary for the project except as provided in Part IV, 1.4.

1.1 Personnel

The Government shall place on special detail four junior University faculty members who will be nominated by the Dean of the Institute of Hygiene and selected by the Johns Hopkins professors and who will proceed to the Johns Hopkins University for further study by means of the fellowship to which reference is made in Part IV, 1.5, without any expense to the University additional to the payments of their full salaries.

1.2 Equipment

The Government shall place at the disposal of the visiting professorial staff such equipment as is at present in the Institute and any extra equipment required as may be agreed upon between the parties concerned.

1.3 Supplies

The Government shall place at the disposal of the Johns Hopkins professors such supplies as are at present in the Institute and any extra supplies required as may be agreed upon between the parties concerned.

1.4 Premises The Government shall provide the lecture rooms and laboratories necessary for teaching by the Johns Hopkins staff and will furnish offices for the staff concerned.

1.5 Travel within the Philippines

The Government shall meet the cost of any necessary official travel within the Philippines for eight Johns Hopkins professors.

1.6 Lodgings

The Government shall either provide adequately furnished lodgings for all eight professors or a cash lodging allowance in lieu thereof. The amount of the cash allowance will be equivalent to the amount in force for other experts provided under the Expanded Programme of Technical Assistance for Economic Development in the Philippines at the time when the professors are in the Philippines.

1.7 Other facilities

Other facilities necessary for the implementation of the project will be those decided upon by the three parties concerned.

2. The Government shall authorize the publication, both national and international, of the results of the project and of the experience derived therefrom in agreement with the other parties concerned.

PART VI

1. This Agreement may be modified by mutual consent of the Government and the Organization with the concurrence of the Johns Hopkins University in regard to those matters affecting the Johns Hopkins University.

2. Any of the three parties of this Agreement may terminate its effects as regards that party by written notice to the other parties, such termination to take effect sixty days from the receipt of such notice.

IN WITNESS WHEREOF, the undersigned, being duly authorized to that effect, have signed this Agreement.

ANNEX

The Institute of Hygiene of the University of the Philippines was established in 1927 through the generosity of the Rockefeller Foundation. From that time until World War II steady progress was made and the activities of the Institute were gradually expanded. Many members of the Faculty obtained postgraduate education in the United States, many of them at the Johns Hopkins University School of Hygiene and Public Health. During the war, the fabric of the building was severely damaged and both during and immediately after the war the services of many of the senior members of the faculty were lost. The Institute of Hygiene of the University of the Philippines, through the Government of the Philippines, approached the World Health Organization for assistance.

The Rockefeller Foundation has continued to maintain its interest in the Institute and the Johns Hopkins University has continued its interest in its former students.

It has therefore been jointly agreed that with the assistance of the World Health Organization and of the Rockefeller Foundation, and with collaboration between the University of the Philippines and the Johns Hopkins University that steps would be taken to strengthen the teaching faculty of the Institute of Hygiene of the University of the Philippines.

The arrangements to which references are made in the body of this Agreement are designed for a two-year period which, with the agreement of all parties concerned, may be extended for a longer period. It has similarly been agreed that while initial arrangements would be made for the loan by Johns Hopkins University of two full professors and two assistant professors for each year of the two-year period, that the number of faculty members interchanged might by mutual consent be increased. The initial arrangements shall be as follows:

In June of 1953 the Johns Hopkins University shall send two senior professors to Manila, where, during a two or three month period, they will study the teaching facilities and requirements of the Institute of Hygiene and will make recommendations to two junior Johns Hopkins University faculty members who would arrive early in August and remain for the duration of the academic year, which year terminates in April. During this period, two junior faculty members of the Institute of Hygiene would travel on fellowships to be granted by the World Health Organization to Johns Hopkins University where they would study under the full professors for one academic year, but would return to the University of the Philippines several weeks before the departure of the Johns Hopkins professors so as to ensure continuity in the teaching. While at Johns Hopkins, the University of the Philippines faculty members would serve on the Johns Hopkins faculty as either visiting assistant instructors, visiting research associates, or visiting assistant professors, according to the ranks of the individuals concerned, At the end of the academic year they will return to the Institute of Hygiene in Manila. It is understood that the junior professors from Johns Hopkins would teach different subjects and would come from different University departments and similarly, the two University of the Philippines faculty members proceeding to Johns Hopkins for further study would be from the corresponding departments of the Institute of Hygiene of the University of the Philippines and would study in the corresponding departments of Johns Hopkins University.

The procedure for the second year will be similar to that described above for the first year except that different departments at the Institute of Hygiene and at Johns Hopkins will be concerned. Johns Hopkins University will supply two departmental heads during the summer of 1954, and two assistant departmental heads from the same departments during the academic year 1954-1955, and WHO will grant two fellowships in these fields to the Institute of Hygiene for studies at Johns Hopkins during this year of the project.

It is understood that the extra funds needed by the Institute of Hygiene for the implementation of Part V points 1.5 and 1.6 of the Agreement, while remaining as an obligation of the Government, would in fact be met by the Rockefeller Foundation in the form of a grant to the Institute of Hygiene. The University of the Philippines will continue to pay the salaries of the four staff members to be sent over the two year period to Johns Hopkins. The fellowships to be awarded by the Organization to these four staff members will be in accordance with the normal fellowship rules of the Organization.

It is further understood that the Rockefeller Foundation will assist the Johns Hopkins University in obtaining suitable replacements for the professors during their period of assignment to the Philippines.
