SUPPLEMENTAL AGREEMENT NO. 5 BETWEEN THE FOOD AND AGRICULTURE ORGANIZATION OF THE UNITED NATIONS AND THE GOVERNMENT OF THE PHILIPPINES FOR THE PROVISION OF TECHNICAL ASSISTANCE TO THE GOVERNMENT

The Food and Agriculture Organization of the United Nations (hereinafter called "the Organization") and the Government of the Philippines (hereinafter called "the Government") desire, subject to the necessary funds being available to the Organization, to implement the Basic Agreement for Technical Assistance concluded between them under date of 26 October 1950, the provisions of which are by reference made a part hereof.

Therefore, the Organization and the Government have entered into this Supplemental Agreement No. 5 through their undersigned duly authorized representatives.

ARTICLE I

TECHNICAL ASSISTANCE TO BE PROVIDED

The Organization shall, within the limits prescribed in the Basic Agreement arrange for three (3) forestry experts (hereinafter called "the personnel") to visit the Philippines (hereinafter called "the Country") as soon as all arrangements have been made, each for a period not exceeding six (6) months to advise and assist the Government in

(i) the reforestation of coniferous trees;

(ii) the logging and transportation of coniferous woods in mountainous areas;

(iii) the floating and transportation of timber in mountainous areas.

ARTICLE II

LIAISON

The Government designates the National Development Corporation as the central coordinating agency for the purpose of Article II of the Basic Agreement, and as the agency with which the Organization will deal in connection with the Technical Assistance rendered under this Supplemental Agreement.

ARTICLE III

DETAILED ADMINISTRATIVE AND FINANCIAL OBLIGATIONS

(a) The obligations of the Organization for costs shall be as set forth in Article III of the Basic Agreement.

(b) The obligations of the Government for costs under Article III of the Basic Agreement shall be subject to the following provisions:

(i) The Government shall provide for each of the Personnel at their Headquarters in the Country lodging of a standard in keeping with the professional and international status of the Personnel. In lieu of lodging the Government shall pay to each of the Personnel a daily lodging allowance equal to forty per cent (40%) of the full subsistence rate set for the Country from time to time by the Technical Assistance Board. The subsistence rate set for the Country by the Technical Assistance Board is, at the time of signing this Agreement, twenty-eight (28) pesos a day. This provision shall continue notwithstanding any temporary absence of the Personnel from their Headquarters.

(ii) The Government shall provide for each of the Personnel for the duration of any official travel in the Country away from their established headquarters, board and lodging of a kind in keeping with their professional and international status. In lieu of Board and lodging the Government shall reimburse each of the Personnel for the actual costs they incur.

(iii) The Government shall, in accordance with paragraph (c) of Article III of the Basic Agreement, establish a local currency fund for operation by the Resident Technical Assistance Representative for the defraying of local currency expenses under the requirements of this Supplementary Agreement. Upon completion of the project the balance remaining in the local currency fund will be returned to the Government.

(iv) Before the arrival of the Personnel the Government shall make such administrative and financial arrangements as necessary for the prompt execution of the provisions of this Supplemental Agreement.

In Witness Whereof, the Government and the Organization have signed this Supplemental Agreement No. 5 at Manila this 30th day of October 1952, in two copies in English. This Supplemental Agreement shall be in force as from this date.
