SUPPLEMENTARY AGREEMENT NO. 6 BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE UNITED NATIONS TECHNICAL ASSISTANCE BOARD

The United Nations (hereinafter referred to as "the Organization”) and the Government of the Philippines (hereinafter referred to as "the Government") pursuant to the Basic Agreement for Technical Assistance signed on 5 April 1951 at Manila between the Organizations represented on the Technical Assistance Board and the Government,

Have agreed as follows:

ARTICLE I

1. The Organization shall provide, as soon hereafter as practicable, and subject to the provisions of the Basic Agreement, to advise the Government as follows:

An expert for a period of one year to supervise all operations in connection with the marble industry in Romblon and to render the required technical assistance to the Cebu Portland Cement Company as consultant, supervisor and advisor.

Three expert marble workers to train the Cebu Portland Cement Company marble workers in Romblon in quarry operation and development and in marble fabrication.

2. In the performance of their duties the experts shall collaborate with the technicians of the Cebu Portland Cement Company and/or such other public or private agencies as may be designated by the Government of the Philippines. Their views, suggestions, and recommendations may be given currently in the course of day-to-day collaborations or in the form of written reports, memoranda, notes, or letters to the agencies concerned. The Secretary-General of the United Nations shall be kept informed, through transmission to him of copies of any such communications and through periodic progress reports made by the experts through the Office of the Resident Technical Assistance Representative. The publication of any report as to the experience, findings and recommendations of the experts which may be of general interest to the United Nations may be undertaken by the Secretary-General. The Government of the Philippines, on its part, may publish, if it so desires, any report prepared by the experts. Publication, whether by the Government of the Philippines or by the Secretary-General, of any such report shall not be undertaken, however, without mutual consultation.

ARTICLE II

1. In accordance with the provisions of the Basic Agreement, the Organization shall, in connection with the technical assistance referred to in this Supplementary Agreement, deal with the agency designated by the Government as the central coordinating agency for these purposes.

ARTICLE III

1. The Government shall, under the provisions of paragraph 2 of Article III of the Basic Agreement, undertake the following:

(a) Provision of lodging for the experts or of 336 pesos per month for each expert to cover the cost of lodging. Initially the company shall make available accommodation for the experts at the site of operation. If, at any subsequent time, any one of the experts wishes to avail himself or alternate accommodation in the city of Romblon or any other town to which his assignment may take him the Government shall pay for such accommodation up to a maximum amount of 336 pesos per month and as agreed upon the General Manager of Cebu Portland Cement Company and the Resident Technical Assistance Representative.

(b) The provision of

(i) medical care and hospitalization of the experts and those immediate dependents who may accompany them while in the country;

(ii) appropriate offices with facilities, supplies, equipment and other materials needed by the experts for their work, as well as postal, telegraph and telephone communications;

(iii) such technical and secretarial help as the experts may need;

(iv) transportation in respect of any official travel which may be undertaken by the experts within the country in the rendering of the technical assistance requested by the Government.

(v) full subsistence for days of travel on duty in the Philippines involving absence from the headquarters covering the actual cost of board and lodging.

2. The Government shall, in accordance with paragraphs 2 and 3 of Article III of the Basic Agreement, establish a local currency fund for the defraying of local currency expenses under the requirements of this Supplementary Agreement. An amount of eleven thousand five hundred pesos per specialist shall be deposited for operation by the Resident Technical Assistance Representative, this being the estimated requirement for the project. The total amount to be deposited for the four experts, P46,000 will be deposited in quarterly installments. The initial deposit of P11,500 will be deposited upon the date of the signing of this Supplementary Agreement. Exactly three months later a sum will be deposited in the amount of the difference between the existing balance and P11,500. Similar deposits will be made at subsequent three months intervals. Any balance remaining upon completion of the project shall be returned to the Cebu Portland Cement Company. If, due to subsequent circumstances, further funds are needed to complete the project they shall be made available in such amount as is necessary by suitable agreement with the Cebu Portland Cement Company.

ARTICLE IV

1. This Supplementary Agreement shall come into force upon signature.

2. This Supplementary Agreement may be modified by agreement between the Organization and the Government in accordance with paragraph 2 of Article V of the Basic Agreement.

3. This Supplementary Agreement may be terminated by either party upon written notice to the other, and shall terminate sixty days after receipt of such notice. Termination of this Supplementary Agreement shall not be deemed to affect the Basic Agreement.

IN WITNESS WHEREOF the undersigned, duly authorized representative of The organization and the Government respectively have signed this Supplementary Agreement No. 6 at Manila this 24th day of April 1952 iii two originals, both in English.
