ASEAN DECLARATION ON HERITAGE PARKS AND RESERVES

Excellency, 

I have the honor to refer to Your Excellency's Note dated 9 April 1985, the text of which is quoted hereunder:

"I have the honour to refer to item 3.2.2 of the Summary Record of 30 June 1983 of the discussions on German-Philippine Development Co-operation held from 28 June to 30 June 1983 in Manila as well as to the Arrangement of 10 November 1981/28 June 1982, and to propose on behalf of the Government of the Federal Republic of Germany that, in pursuance of the Agreement of 7 September 1971 between our two Governments concerning Technical Co-operation, the following Arrangement concerning the project "Advisory service for the Philippine economy" be concluded.

1. (1) The Government of the Federal Republic of Germany and the Government of the Republic of the Philippines shall continue their co-operation on the project based at the Board of Investments (BOI), Manila from January 1984 to December 1986, with a view to promoting co-operation between German (or European) and Philippine private enterprises, particularly as regards joint ventures, export and technology transfer.

(2) The Government of the Federal Republic of Germany shall charge the Deutsche Gesellschaft fur Technische Zusammenarbeit (GTZ) GmbH, 6236 Eschborn, with the implementation of its contributions: the GTZ shall, in turn, charge the Deutsche Finanzierungagesellschaft fur Beteilingungen in Entwicklungslandern GmbH (DEG) (German Finance Company for Investments in Developing Countries), Koln, or a suitable consulting firm with the execution of the project activities.

(3) The BOI (implementing agency) and the DEG shall jointly agree on details of the implementation of the project in a plan of operations or in some other appropriated form, adapting them as necessary in line with the progress of the project.

2. The Government of the Federal Republic of Germany shall make the following contributions:

It shall

(a) extend the period of assignment of the seconded industrial consulting expert by three years (including leave);

(b) second short-term experts for special tasks for a total of up to eighteen man/months;

(c) meet the costs of accommodation for the seconded experts and their families, insofar as such costs are not met by the experts themselves;

(d) meet the cost of necessary official travel by the seconded experts inside and outside the Republic of the Philippines;

(e) assume maintenance costs for the official car put at the disposal of the seconded industrial consulting expert;

(f) assume costs of up to DM 50,000 (fifty thousand Deutsche Mark) for short-time training of Philippine employees of the BOI in the Federal Republic of Germany through collaboration on the project on the German side;

(g) meet the cost of promotion work in the Federal Republic of Germany.

3. The Government of the Republic of the Philippines shall make the following contributions: It shall

(a) make available to the seconded industrial consulting experts two experts from the BOI as counterparts;

(b) provide suitable offices, the necessary office aids as well as adequate secretarial services;

(c) assist the seconded experts in establishing contacts with Philippine agencies and enterprises;

(d) make available sufficient funds for advertising aimed at promoting co-operation between Philippine and German enterprises.

4. The seconded industrial consulting expert shall perform the following tasks:

(a) identify the wishes for co-operation of Philippine entrepreneurs;

(b) examine and process cases where interest in co-operation exists;

(c) advise Philippine, German or European entrepreneurs, plan co-operation and assist entrepreneurs in the phase between planning and carrying out joint projects;

(d) prepare the terms of reference for the assignment of short-term experts and the organization of the assignments;

(e) provide assistance in the assignment of senior experts in the Philippines;

(f) prepare general promotion documents.

5. In all other respects the provision of the aforementioned Agreement of 7 September 1971, including the Berlin clause (Article 9) shall apply to the present Arrangement.

If the Government of the Republic of the Philippines agrees to the proposals contained in paragraphs 1 to 5 above, this Note and Your Excellency's Note in reply thereto expressing your Government's agreement shall constitute an Arrangement between our two Governments, to enter into force on the date of your Note in reply.

Accept, Excellency, the assurance of my highest consideration.

I have the honor to inform Your Excellency that my Government agrees to the proposals contained in paragraphed 1 to 5 quoted above, and that Your Excellency's Note and this Note shall constitute an Arrangement, between our two Governments to take effect on the date of this reply.
