SUPPLEMENT T0 THE AGREEMENT BETWEEN THE PHILIPPINES AND THE UNITED STATES FOR THE SALE OF CERTAIN SURPLUS WAR PROPERTY

Note: The Agreement entered into force, April 20, 1950.

Reference: This Agreement is also published in I DFA TS No. 4, p. 111.

This supplementary agreement between the Governments of the Republic of The Philippines, hereinafter called "Philippines", and The Government of the United States of America, hereinafter called the "United States."

Witnesses:

WHEREAS the Philippines and the United States, by an agreement dated September 11, 1946, provided for the transfer of certain surplus property to the Philippines; and

WHEREAS the agreement of September 11, 1946, provided for appropriate settlement and adjustment of the terms of the transfer upon determination of the quantities of property subject to the agreement,

Now, therefore, in consideration of the premises and the mutual agreements and covenants hereinafter stated, it is agreed:

1. With the exception of certain installations more specifically described in annex A, attached hereto, deliveries of property available for transfer under the terms of the agreement of September 11, 1946, were completed as of September 30, 1949.

2. The installations listed in Paragraph 1 of Annex A will be transferred by, at the time of execution of this agreement.

3. The remaining installations described in Annex A, some of which are subject to occupancy by agencies of the United States for an indefinite future period, will be transferred to the Philippines as soon as possible after the owning agency of the United States Government files appropriate surplus declarations. The transfer will be affected by a notification of availability from the Department of Foreign Affairs of the Philippines.

4. After March 31, 1950, any surplus property which has previously been transferred under the agreement and which remains on land owned, used, or controlled by the United States may, at the discretion of the United States, be moved at the expense of the Philippines to the nearest land owned, used, or controlled by the Philippines.

5. It is agreed that, upon completion of the acts called for in this agreement, the United States will have completely and satisfactorily fulfilled its obligation arising under the terms of the agreement of September 11, 1946 and the Republic of the Philippines will have fulfilled all of its financial obligations arising under that agreement.

IN WITNESS WHEREOF, the undersigned, duly authorized thereto have signed the present Agreement in duplicate at Baguio this 20th day of April, 1950.

ANNEX “A"

FIXED INSTALLATIONS LATER TO BECOME SURPLUS

1. Installations at Fort McKinley and Nichols Field area at present under the control of the Philippine Armed Forces in accordance with the terms of a memorandum receipt signed August 3, 1949.

2. Installations at Diliman Housing Area, Quezon City, Rizal, consisting of Headquarters and housing for Adjutant General Records Depository.

3. Two hangars at Nichols Field (800 & 801) at present being used by American Graves Registration Service.

4. Installations at the 10th General Hospital.

5. Installations in the PASC housing area.

6. Installations at Maned Headquarters and billeting areas.

7. Installations occupied by the 29th Topographical Battalion at Old Cavite Navy Yard.

8. Installations known as the Port Area facilities.

9. Communication facilities serving the above listed installations.
