EXCHANGE OF NOTES CONSTITUTING AN AGREEMENT AMENDING THE AGREEMENT BETWEEN THE PHILIPPINES AND THE UNITED STATES OF AMERICA REGARDING A ROAD, STREET AND BRIDGE PROGRAMME[1]

THE AMERICAN AMBASSADOR TO THE PHILIPPINE SECRETARY OF FOREIGN AFFAIRS

EMBASSY OF THE UNITED STATES OF AMERICA

December 16, 1949

Excellency:

I have the honor to refer to Article XVI of the Agreement between the United States of America and the Republic of the Philippines Regarding a Road, Street and Bridge Program, executed on February 14, 1947, which is quoted below:

"This Memorandum of Agreement shall become effective on the date of its signature and continue in effect until June 30, 1950; however, this Agreement may be revised, amended, or changed in whole or in part with the approval of both parties as indicated and effected by an exchange of notes between the two contracting parties; and further, either party may terminate this Agreement by giving to the other party ninety days notice in writing through diplomatic channels."

Public Law 295 of the 81st United States Congress extends the authorized period of operation of this program to June 30, 1951. It is therefore appropriate to amend the above-quoted article to change its termination date to June 30, 1951. Your Excellency's acknowledgment of this note will be construed as acceptance of this revision without prejudice to any further revisions which may be necessary in the future in accordance with the amending procedure quoted above.

Excellency:

I have the honor to acknowledge the receipt of Your Excellency's note No. 1223, dated December 16, 1949, which reads as follows:

The Government of the Republic of the Philippines has duly noted the above quoted note of the Government of the United States of America and agrees fully with the statements contained therein.

Accordingly, I have the honor to state that Your Excellency's note, together with this reply; will be considered by this Government as placing on record the understanding of the two governments in regard to this matter.
