EMBASSY OF THE UNITED STATES OF AMERICA

The Embassy of the United States of America presents its compliments to the Department of Foreign Affairs of the Republic of the Philippines and has the honor to refer to the Uruguay Round Agreement on Textiles and Clothing done at Marrakesh April 15, 1994; to the Agreement between the Governments of the United States and the Philippines concerning trade in cotton, wool and manmade fiber, silk blend and other non-cotton vegetable fiber textiles and textile products, as amended and extended by exchange of notes dated March 10 and March 19, 1994 in Washington, D.C.; and to the visa arrangement between the Philippines and the United States of America concerning textile and textile products established on March 24, 1987 (The Arrangement).

The Embassy has the further honor to refer to its January 19, 1996 note proposing an amended Arrangement which includes an Electronic Visa Information System (The ELVIS Arrangement); to the Government of the Philippines' April 1, 1996 note suggesting certain changes to the draft ELVIS Arrangement; to the Embassy's December 18, 1996 note proposing an amended draft ELVIS Arrangement; and to the Government of the Philippines' July 9, 1997 note" of acceptance (number 972009) with one proposed change to the draft amended ELVIS Arrangement.

On behalf of the Government of the United States, the Embassy accepts the Government of the Philippines' proposal that paragraph 6 B of the draft amended ELVIS Arrangement be deleted.

Absent communications to the contrary from the Government of the Philippines, the Government of the United States intends to implement the ELVIS Arrangement on September 1, 1997.

Since the terms of the proposed ELVIS Arrangement are acceptable to the Governments of the Philippines and the United States, this note, together with the notes referred to above, shall constitute the agreed ELVIS Arrangement between the two Governments, which shall enter into force on September 1, 1997.

The Embassy of the United States of America avails itself of this opportunity to renew to the Department of Foreign Affairs the assurances of its highest consideration.
