AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF ROMANIA ON COOPERATION IN THE FIELD OF TOURISM

The Government of the Republic of the Philippines and the Government of Romania (hereinafter referred to as "the Contracting Parties"); 

Desiring to further develop; the links of friendship between the two states and to increase cooperation in the field of tourism between them; 

Considering the importance of tourism as a factor of economic development and understanding between nations;

Have agreed on the following:

ARTICLE 1

The Contracting Parties shall promote bilateral tourism in accordance with the laws, and regulations in force in their respective states by encouraging their own tourists to visit each other's state;

ARTICLE 2

The Contracting Parties shall promote die mutual increase of tourist traffic by encouraging cooperation between the firms and organizations of the two states involved in tourism;

ARTICLE 3

The Contracting Parties shall encourage within the framework of this Agreement . the dissemination and exchange of information related to tourism.

The Contracting Parties shall encourage the exchange of delegations of experts in the field of tourism with the purpose of being acquainted with the tourism infrastructure and also with the view of carrying on tourism activities.

ARTICLE 4

The Contracting Parties shall exchange tourist promotional materials and shall encourage the participation of travel agencies and other companies from, the field of tourism in commercial . and cultural tourism events organized in the two states.

All advertising and documentary materials as well as samples of the kind, in such quantity and such dimensions or construction as to make them impossible to sell or not having commercial value, all being destined for tourism exhibitions shall, in so far as permissible in the host state, be exempted from taxation. However, if such materials are sold in the importing; state, then they become liable to the payment of duties and taxes, according to the customs and taxes regulations of that state.

ARTICLE 5

The Contracting Parties shall explore the possibilities of joint collaboration for investment in the tourism sector and shall inform each other about the investment conditions provided by the national legislation of each state.

The Contracting Parties shall encourage the competent bodies and interested organizations to set up joint ventures and other investment projects in the field of tourism in accordance with their respective laws and regulations.

ARTICLE 6

The Contracting Parties, through their competent bodies and interested organizations, shall consider the possibilities for the expansion of technical cooperation in the field of education and training for tourism sector, especially for personnel engaged in the tourism industry. 

ARTICLE 7

The Department of Tourism of the Republic of the Philippines and the Ministry of Tourism of Romania shall be the responsible bodies for- the implementation of this Agreement.

ARTICLE 8

The expenses Incurred during the implementation of this Agreement shall be borne by the Contracting Parties as follows:

a) Visits and Exchanges - the sending Party shall be responsible for die expenses incurred by his delegation.

b) All other activities for cooperation - the expenses for all other activities shall be subject to the mutual agreement of the participants in accordance with the legislation o state.

ARTICLE 9

The present Agreement shall enter into force on the date of the exchange of Notes which confirms the completing of the legal requirements for the entry into force of the Agreement, in accordance with the legislation of each state.

ARTICLE 10

This Agreement is valid for a period of five years and shall be automatically renewed for successive five years periods, if neither of the Contracting Parties informs the other in "writing, six months prior to its expiry of an intention to renounce it.

The termination of this Agreement shall not affect the implementation of the programs and activities agreed upon during the validity of this Agreement.

Signed in Manila, on the 22nd day of May, 1997, in two originals, each in English and Romanian languages, both texts being equally authentic.
