AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA ON THE ESTABLISHMENT OF ADDITIONAL CONSULATES-GENERAL

With a common desire to further strengthen bilateral cooperation in consular affairs and develop friendly relations between the two countries, the Government of the Republic of the Philippines and the Government of the People's Republic of China, have reached agreement on the establishment of Consulates-General as follows:

ARTICLE ONE

The Government of the Republic of the Philippines gives its consent to the Government of the People's Republic of China for reserving the right to establish a consulate-general in Davao, with a consular district comprising Basilan, Sulu, Tawi- Tawi, Zamboanga del Norte, Zamboanga del Sur, Agusan del Norte, Agusan del Sur, Bukidnon, Camiguin, Misamis Occidental, Misamis Oriental, Surigao del Norte, Davao del Norte, Davao del Sur, Davao Oriental, South Cotabato, Surigao del Sur, Lanao del Norte , Lanao del Sur, Maguindanao, North Cotabato and Sultan Kudarat.

ARTICLE TWO

The Government of the People's Republic of China gives its consent to the Government of the Republic of the Philippines for establishing a consulate-general in Guangzhou, with a consular district comprising Guangdong Province, Guangxi Zhuang Autonomous Region, Hainan Province and Hunan Province. The consular district of the Consulate-General of the Government of the Republic of the Philippines in Xiamen comprises Fujian Province, Jiangxi Province and Zhejiang m Province correspondingly.

ARTICLE THREE

The total number of staff members for either consulate-general shall not exceed twelve (12). Any increase in staff members shall be decided through separate consultations by the two sides.

ARTICLE FOUR

Either side may open its consulate-general as specified in this agreement at a time it deems appropriate.

ARTICLE FIVE

In keeping with the Vienna Convention on Consular Relations of 24 April 1963, the relevant laws and regulations of the respective countries and the principle of reciprocity, the two sides shall provide each other with the necessary assistance for the establishment of the consulates-general.

ARTICLE SIX

Problems relating to the consular relations between the two countries shall be settled through friendly consultations in accordance with the principles of international law and practice and the Vienna Convention on Consular Relations of 24 April 1963.

ARTICLE SEVEN

This agreement shall enter into force as from the date of its signature.

Done in Manila, on November 26, 1996 in duplicate in the English and Chinese languages, both texts being equally authentic.
