CULTURAL AGREEMENT between THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE REPUBLIC OF PERU

The Government of the Republic of the Philippines and the Government of the Republic of Peru; In acknowledgement of the traditional relations of friendship that bind their peoples;

Inspired by the desire to promote and develop cooperation in the fields of culture and education between the two countries, both blessed with patrimonies of culture and history; and

Convinced that cooperation will contribute to the increase of mutual understanding and friendship that exist between the two countries;

Have decided to concretize a Cultural Agreement and have agreed on the following:

ARTICLE I

1.The two Governments will encourage an interchange between the two countries of experts, professors, researchers, students, artists, and other persons who are dedicated to cultural, educational or research activities.

2.The two Governments will encourage the expansion of cooperation between cultural institutions, and other educational and research institutions.

ARTICLE II

Each Government, subject to its laws, rules and regulations, will permit in its country the entry of nationals of the other under scholarship programs and other facilities for study and research.

ARTICLE III

Each Government will encourage, in its country, the instruction and research of the language, literature, history, culture and other aspects of the other country in universities and other educational and research institutions.

ARTICLE IV

The two Governments will study in what manner and under what conditions they would be able to confer the equivalent in each country, for academic purposes, or in appropriate cases for professional objectives, to the degrees, diplomas and certificates obtained in the course or at the end of studies in universities or other educational institutions, as well as other diplomas obtained, in the other country.

ARTICLE V

Each Government will provide, in its country, to the nationals of the other, facilities to access art galleries, museums, libraries, archives, centers of documentation, and other institutions of cultural character.

ARTICLE VI

Each Government will foment and facilitate the understanding of culture, history, institutions and way of living of the other country, specially through:

a) books, newspapers, and other publications;

b) radio and television programs;

c) films, magnetophonic tapes, records and other audiovisual materials;

d) expositions of fine arts, artifacts and others of cultural character;

e) conferences, seminars and congresses;

f) concerts and theatrical arts;

g) festivals and international compositions of cultural character; and

h) any other artistic or cultural expression.

ARTICLE VII

Each Government will encourage, in its country, the translation, reproduction and publication of literary works, artistic or of academic character produced by the nationals or organizations of the other country.

ARTICLE VIII

The two Governments will foment the cooperation and the interchange among the youth and youth organizations as well as among athletes and sports organizations of the two countries.

ARTICLE IX

The two Governments will facilitate the interchange in the fields of the printed press, radio, television and cinematography.

ARTICLE X

The two Governments will encourage and facilitate tourism between the two countries with the end in view of fomenting mutual understanding between their peoples.

ARTICLE XI

The two Governments will undertake inquiries between them, to ensure the implementation of the present Agreement, every time it is necessary or at the request of either of them.

ARTICLE XII

The present Agreement will be ratified and will be effective on the 30th day from the date of exchange of instruments of ratification that will take place in Manila.

ARTICLE III

The present Agreement will remain in force for a period of five (5) years and, after the expiry of this period, will continue to be valid until the end of one year from the date in which anyone of the two Governments has communicated in writing its intention to revoke the Agreement.

IN WITNESS THEREOF, the undersigned, duly authorized by their respective Governments, have signed the present Agreement.

Done at Manila on this 15th day of November 1996, in two copies, in the English and Spanish language, both texts being equally authentic.
