AGREEMENT ON SCIENTIFIC AND TECHNICAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE REPUBLIC OF THE GAMBIA

The Government of the Republic of the Philippines and the Government of the Republic of the Gambia, hereby referred to as the Contracting Parties;

Desiring to strengthen the cordial and friendly relations existing between the two countries; and

Desiring to foster scientific and technical cooperation between the two countries in conformity with their socio-economic development programs, based on equitable and mutually beneficial bases, have agreed as follows:

ARTICLE I

The Contracting Parties, in accordance with their respective laws, rules and regulations, shall cooperate in a Program of Scientific and Technical Cooperation to encourage economic and social development in both countries.

ARTICLE II

Within the framework of this Agreement, scientific and technical cooperation shall include the following mechanisms:

1) exchange of scientific and technical information;

2) exchange of scientists, technologists, experts and research workers in scientific and technical fields; and

3) other forms of scientific and technical cooperation that may be mutually agreed upon.

ARTICLE III

To implement the scientific and technical cooperation provided for in Article II above, I the Contracting parties shall negotiate and conclude specific arrangements in accordance with the provisions of this Agreement.

ARTICLE IV

The scientists, technologists, experts, research workers and other persons exchanged under this Agreement shall observe the laws and regulations in force in the country to which they are sent.

Each Party shall give the scientists, technologists, experts, research workers, and others sent by the other Party under this Agreement the necessary assistance so that they may accomplish their mission.

The provisions of the present Agreement shall not limit the right of either Contracting Party to adopt or execute measures for reasons of public health, order or security.

ARTICLE V

Each Contracting Party pledges not to convey to a third country or citizens or organizations of a third country, without the written approval of the other Contracting Party, special scientific and technical knowledge acquired in the course of the implementation of the present Agreement.

ARTICLE VI

Both Contracting Parties shall upon the explicit request of either of them, consult each other on any matter relating to the implementation of the present Agreement.

ARTICLE VII


For the implementation of this Agreement, the agencies designated are the Department of Science and Technology and other relevant agencies of the Government of the Republic of the Philippines and the Ministry of External Affairs and other relevant agencies of the Government of the Republic of The Gambia.

ARTICLE VIII

The present Agreement shall enter into force upon the exchange of instruments of I ratification between the Contracting Parties. It shall be valid for a period of two (2) years and could be extended thereafter by tacit agreement from year to year until either party gives six (6) months notice of its intention to terminate it.
Done in the City of Manila this 26th day of June 1996 in two original copies in English, both copies being equally authentic.
