AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM ON SCIENTIFIC AND TECHNOLOGICAL COOPERATION

THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES and THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM, hereinafter referred to as "Contracting Parties",

DESIRING to promote closer scientific and technological cooperation on the basis of mutual benefit, and

PURSUANT to the Agreement between The Government of The Republic of The Philippines and The Government of The Socialist Republic of Vietnam on Economic, Scientific and Technical Cooperation dated 9 January 1978,

HAVE AGREED AS FOLLOWS:

ARTICLE I

The Contracting Parties shall promote, in accordance with their respective laws and regulations, scientific and technological cooperation between the two countries in the fields of mutual interest, which may include cooperation in the areas inter alia identified in the Appendix attached hereto.

ARTICLE II

In order to attain the objectives stipulated in Article I above, the following. activities shall be undertaken:


(a) exchange of scientific and technological information, knowledge and experience;

(b) exchange of technical and other personnel for the study, observation, research and training in scientific and technical fields;

(c) joint or coordinated- implementation of programs, projects and activities in the territories of one or both Contracting Parties; and

(d) other forms of scientific and technological cooperation mat may be agreed upon by the Contracting Parties.

ARTICLE III

The terms and conditions including the expenses to be incurred shall be agreed upon by the Contracting Parties in respect of each specific programme, project or activity undertaken pursuant to this Agreement.

ARTICLE IV

Subject to the existing laws and regulations of their respective Countries, each Contracting Party shall grant to the citizens of the other Contracting Party undertaking activities pursuant to this Agreement, all possible assistance necessary to facilitate their work.

ARTICLE V

For the purpose of implementing this Agreement the Contracting Parties hereby agree to establish a Technical Working Group which shall meet at the request of either Contracting Party. Such meeting shall be held alternately in The Republic of The Philippines and The Socialist Republic of Vietnam.
The Republic of The Philippines shall be represented by The Department of Science and Technology and The Socialist Republic of Vietnam shall be represented by The Ministry of Science, Technology and Environment.

ARTICLE VI

The provisions of the present Agreement shall not limit the rights of either Contracting Party to adopt and execute measures relating to the protection of respective national security.

ARTICLE VII

Either Contracting Party may request in writing a revision or amendment of this Agreement. Any revision or amendment agreed to by both Contracting Parties shall be reduced in writing and shall form part of this

Agreement. Such revision or amendment shall come into effect on such date as may be mutually decided by both Contracting Parties.

ARTICLE VIII

Any difference or dispute arising out of the interpretation or application of the provisions of the foregoing articles shall be settled amicably by consultation or negotiation between the Contracting Parties without reference to any third party or international tribunal.

ARTICLE IX

This Agreement shall enter into force on the date of exchange of diplomatic notes confirming the completion of their respective constitutional requirements by the Contracting Parties until terminated by either Contracting Party by giving written notice of termination to the other through diplomatic channel, at least six months prior to the intended date of termination. The termination of this Agreement shall not affect the validity of programs, projects, activities or any other cooperation assumed or undertaken during the period of the validity of this Agreement.

IN WITNESS WHEREOF, the undersigned, being duly authorised by their respective Governments, have signed the present Agreement.

Done in duplicate at Hanoi this 24th day of April, 1996 in the Vietnamese and English languages, the two texts being equally authentic. In case of difference in the interpretation of the Agreement, the English text shall prevail.
