AGREEMENT ON CULTURAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE FEDERAL REPUBLIC OF GERMANY

The Government of the Republic of the Philippines and the Government of the Federal Republic of Germany hereinafter referred to as the Contracting Parties,

Desiring to strengthen relations between their peoples in the fields of culture and education,

Convinced that friendly co-operation and cultural exchanges will foster understanding of the culture, intellectual activities and way of life of the people of the other country, Have agreed as follows:

ARTICLE I

The Contracting Parties shall endeavour to improve mutual knowledge of the culture of their countries and to assist each other in achieving this aim, on the basis of mutual respect for their sovereignty and in conformity with the laws and regulations in force in each country, having in mind the interest of their respective peoples.

ARTICLE II

1. To this end each Contracting Party shall endeavour within the framework of the applicable laws and regulations and under conditions to be mutually agreed, to admit cultural institutions of the other Contracting Party and as far as possible facilitate and promote their activities.

2. "Cultural institutions" within the meaning of paragraph 1 of this Article are in particular schools, cultural institutes, libraries and similar cultural institutions; the details shall be worked out through diplomatic channels .

ARTICLE III

In the field of education, including universities and other institutions of higher education, general and vocational schools, organizations and institutions of non-school education and further adult education, school and vocational training administrations and other educational and research institutions both Contracting Parties shall encourage co-operation in all its forms and endeavour to promote the exchange of scholars, teachers and instructors, students and trainees.

ARTICLE IV

The Contracting Parties shall, where possible, provide scholarships for training, further training, or research for qualified students and scholars of the other country.

ARTICLE V

The Contracting Parties shall endeavour to promote the study of the language, culture and literature of the other country by such means as they may deem appropriate in the course of co-operation.

ARTICLE VI

In order to impart a better knowledge of the art, literature and related fields of the other country, the Contracting Parties shall, on the basis of reciprocity, endeavour to carry out measures serving this purpose and assist each other as far as possible, particularly:

1. With regard to guest performances by individual artists and ensembles and in the organization of concerts and other artistic performances;

2. In the organization of exhibitions;

3. In the organization of visits by representatives of the different spheres of cultural life, in particular literature, music, the interpretative and fine arts for the purpose of exchanging experience and participating in conferences and similar events .

ARTICLE VII

The Contracting Parties shall seek to promote cooperation between the competent organizations in the field of films, television and radio broadcasting.-

ARTICLE VIII

The Contracting Parties shall endeavour to encourage meetings between sportsmen and sports teams and to promote co-operation between sports organizations of their countries.

ARTICLE IX

This Agreement shall also apply to Land Berlin, provided that the Government of the Federal Republic of Germany does not make a contrary declaration to the Government of the Republic of the Philippines within three months of the date of entry into force of this Agreement,

ARTICLE X

This Agreement shall enter into force as soon as the Contracting Parties have informed each other that their domestic requirements for such entry into force have been fulfilled.

ARTICLE XI

This Agreement shall be concluded for a period of five years and be tacitly extended for an unlimited period unless terminated in writing by either Contracting Party subject to six month's notice.

Done at Manila on 13 April 1983 in duplicate in the English, Pilipino and German languages, all texts being equally authentic. In case of divergent interpretation of the Filipino and German texts, the English text shall prevail.
