AGREED MINUTES OF THE FIRST MEETING OF THE REPUBLIC OF THE PHILIPPINES GREAT SOCIALIST PEOPLE'S LIBYAN ARAB JAMAHIRIYA JOINT GOVERNMENTAL COMMISSION 4 TO 5 OCTOBER 1995
To further promote economic, scientific and technical cooperation between the the Republic of the Philippines and the Great Socialist People's Libyan Arab Jamahiriya, and in implementation of the Economic, Scientific, Cultural and Technical Cooperation Agreement signed between the two Governments in the City of Tripoli on 1 6 November 1 976, the First Meeting of the Philippines-Libya Joint Governmental Commission was held in Manila on 4 and 5 October 1995.
The Philippine panel was headed by Hon. Federico M. Macaranas, Undersecretary of the Department of Foreign Affairs while the Libyan delegation was headed by H.E. Ahmed Ben Khayal, Deputy Secretary of the General People's Committee for Foreign Liaison and international Cooperation while. Attached as annex "A" is the list of the members of both panels.
In the spirit of understanding and cooperation between the two countries, both panels presented their views on matters relating to bilateral cooperation, and came to agreement on several important points.
1.0 Manpower and Social Security Cooperation
1.1 On Manpower Cooperation
1.1.1 In recognition of their mutually beneficial relationships in the field of labor, and as a means to further strengthen cooperation in this field between the two Governments, the Libyan panel agreed to continue the recruitment of Filipino medical and paramedical staff and the Philippine panel agreed to supply qualified workers to the different health sectors in Libya, on terms and conditions consistent with the laws and regulations applicable in each other's territory.
1.1.2 In relation to the deployment of medical and paramedical workers, both panels recognized the need to rationalize or streamline the recruitment process of the workers. For this purpose, the Philippine Government shall make available its offices and facilities in providing the required services. On its part, the Libyan Government shall undertake to resolve problems pertinent to the full implementation of employment contracts of the medical and paramedical workers, including but not necessarily limited to accommodations; issuance of entry/work/exit visas; salary remittances; vacation/sick leave benefits; and such other benefits incidental to employment, in accordance with Libyan laws and regulations.
1.1.3 As a means of enhancing and protecting the welfare and rights of the workers, and in order to be assured that only qualified personnel are employed, the Libyan pane! requested, and the Philippine panel agreed, to review the recruitment process, including the manner by which notice thereof is issued. The Libyan Government will select recruitment offices with the financial and administrative capability to facilitate the deployment of selected medical workers to work in Libya.
1.1.4 To further enhance and protect the welfare of all workers, the Governments of the Republic of the Philippines and the Great Socialist People's Libyan Arab Jamahiriya agreed to conclude within six months a bilateral agreement on Manpower Cooperation and further agreed that negotiations thereof shall commence , as soon as possible, alternately, in their capitals beginning in Tripoli.
1.1.5 The Philippine panel requested that its manufacturers and businessmen be given the opportunity to enter into the market for the supply of medical equipment, facilities, supplies, and pharmaceutical products. The Libyan panel expressed full agreement with the request, and in connection therewith, recommended the participation of such manufacturers and businessmen in trade fairs or presentations of their products through other means such as catalogues or video presentations.
1.2 On Health and Social Security Cooperation
1.2.1 Both panels expressed their desire to conclude a Social Security Agreement between the Republic of the Philippines and the Great Socialist Libyan Arab Jamahiriyah. The agreement is to be concluded in a meeting to be held in the Great Socialist People's Libyan Arab Jamahiriyah at a date to be mutually agreed upon.2.0 Cooperation in the Field of Trade
2.1 The two panels discussed the many export and import opportunities in each other's countries and agreed to:
i. Promote their companies specializing in the field of import and export, through bilateral visits;
ii. Exchange lists of goods ready for importation and exportation between the two countries (annexes "B" and "C");
iii. Promote companies for possible trade fairs and exhibitions to be held in both countries;
iv. To utilize counter-trade, if possible.2.2 The Philippine panel expressed its wish for the importation of other industrial products from Libya like iron, steel slabs and billets, cement, and chemical and petrochemical products.
2.3 The Libyan Arab panel expressed their readiness to accept the request of the Philippines in the spirit of the talks.3.0 Cooperation in the Field of Industry
3.1 Both panels agreed to exchange information on industrial cooperation between their two countries. Both countries also expressed their desire to develop cooperation in the field of industry through:i. Exchange of information;
ii. Exchange of visits of technical experts; and
iii. Cooperation in the field of research and development.3.2 Likewise the Libyan panel expressed their wish to utilize Philippine technical manpower and specialists, as well as Philippine materials which will be utilized for the operation of Libyan factories.
4.0 Cooperation in the Field of Communications and Transportation
4.1 Both panels expressed the possibilities of cooperation in this field. The Philippines offered computer software and hardware in the field of communications and consultancy on mass transit system, and other items identified in Annex "B".
5.0 Cooperation in the Field of Tourism
5.1. The Philippine panel expressed interest in providing The Great Socialist People's Libyan Arab Jamahiriya with hotel construction and management, upgrading and furnishing, administration and staffing.Both panels agreed to hold a second meeting of the RP-Libya Joint Governmental Commission in Tripoli during the last half of 1996, at a date to be mutually agreed upon.
Done in the City of Manila this fifth day of October, nineteen-hundred and ninety-five, in the English and Arabic languages, both versions being equally authentic.
