The Embassy of the Philippines presents its compliments to the Ministry of Foreign Affairs of the People's Republic of China and,-with reference to the Embassy's. Note No. 362/94 dated 7 November 1994 regarding the desire of the Philippine Government to establish a Consulate-General in Xiamen, has the honor to propose the following arrangement between the Government of the Philippines and the Government of the People's Republic of China with respect to the mutual establishment of Consulates-General;

1. The Government of the Philippines shall establish a Consulate-General in the Chinese City of Xiamen, with the Provinces of Fujian, Guangdong and Hainan as its consular district.

2. The Government of the People's Republic of shall establish a Consulate-General in the Philippine City of Cebu, with the provinces of Iloilo, Negros Occidental, Bohol, Cebu, Negros Oriental, Siquijor, Eastern Samar, Leyte, Northern Samar, Western Samar and Southern Leyte as its consular district.

3. Each of the two Governments shall, in accordance with the laws and regulations of their respective countries, provide all necessary assistance to the other in-the establishment of its Consulate-General and the performance of its functions.

4. The consular relations "between the two Governments .shall be. governed by the Vienna Convention on Consular Relations, principles of international law and international practice. Problems concerning consular relations may be solved, on the basis of reciprocity, through friendly consultations between the two Governments,

5. Either Government may open its Consulate-General on a date it deems appropriate after the confirmation of this arrangement.

The Embassy wishes further to propose that this Note and the Ministry's Note in reply confirming the contents of this Note shall constitute an agreement which shall enter into force on the date of the Ministry's reply.

The Embassy of the Philippines avails itself' of this opportunity to renew to the Ministry of Foreign Affairs of the People's Republic of China the assurances of its highest consideration.

The Ministry of Foreign Affairs of the People's Republic of China/presents its compliments to the Embassy of the Philippines in China and has the honour to acknowledge the receipt of the latter's note No.382/94 dated Dec. 8, 1994, which reads as follows;

"The Embassy of the Philippines presents its compliments to the Ministry of Foreign Affairs of the People's Republic of China and, with reference to the Embassy's Note No. 362/94 dated 7 November 1994 regarding the desire of the Philippine Government to establish a Consulate-General in Xiamen, has the honor to propose the following arrangement between the Government of the Philippines and the Government of the People 's Republic of China with respect to the mutual establishment of Consulates-General:

The Ministry of Foreign Affairs of the People's Republic of China hereby confirms the content of the above note on behalf of the Government of the People's Republic of China.
