AGREEMENT CONCERNING THE USE OF EXPERTS FOR TECHNICAL COOPERATION AMONG DEVELOPING COUNTRIES

This Agreement is hereby concluded between the Government of the Republic of the Philippines ("the Government Party") and the Food and Agriculture Organization of the United Nations ("FAO").[1]

ARTICLE I
PARTICIPATION IN THE SCHEME

The Government Party hereby agrees to participate in the FAO Scheme for Technical Cooperation among Developing Countries ("the FAO Scheme") in accordance with the terms and conditions set out in this Agreement.

ARTICLE II
PURPOSE OF THE SCHEME

The purpose of the FAO Scheme is to foster technical cooperation among developing countries, on priority programmes in the fields of agriculture, forestry and fisheries, with a view to promoting the individual and collective self-reliance of developing countries through exchange of experience, sharing of technical expertise and development of complementary capacities.

ARTICLE III
PROJECT AGREEMENTS

1. The Government Party will inform FAO in respect of each particular project or series of projects whether it wishes to participate in those projects as a country requesting assistance - ("Beneficiary Government") or as a country providing expert service ("Releasing Government").

2. The particular conditions for expert assignments within the framework of this Agreement shall be set out in specific agreements to be concluded for each particular project or series of projects by the Beneficiary Government, the Releasing Government and FAO, in accordance with the general terms set out in this Agreement.

ARTICLE IV
OBLIGATIONS OF THE RELEASING GOVERNMENT

1. The Releasing Government will select suitable experts meeting the requirements specified by the Beneficiary Government.

2. The selection of each expert will be subject to the approval of the Beneficiary Government and of FAO.

3. The Releasing Government will be responsible for the salary of the experts.

ARTICLE V
OBLIGATIONS OF THE BENEFICIARY GOVERNMENT

1. The Beneficiary Government will assume responsibility for the payment of reasonable local expenses of board and lodging (including laundry) for each expert during the period that he is working on an approved project in the country of the Beneficiary Government.

ARTICLE VI
OBLIGATIONS OF FAO

1. FAO will reimburse to the Releasing Government to provide, as appropriate, in respect of each approved expert while that expert is working on an approved project under this scheme in the country of the designated Beneficiary Government:

(a) a lump sum of US$ 300 per month as a contribution to the salary of the expert;

(b) all reasonable costs of international travel approved by FAO;

(c) all reasonable costs of internal travel approved by FAO;

(d) all reasonable costs of accident and medical insurance; and

2. FAO will reimburse or provide directly, as appropriate, to the expert, a lump sum corresponding to US$50.00 per day in respect of local living expenses while that expert is working on an approved project under these scheme in the country of the Beneficiary Government.

ARTICLE VII
REVIEW OF AMOUNTS OF MONETARY PAYMENTS

The amounts of monetary payments specified in Article VI shall be subject to review every two years by the parties hereto.

ARTICLE VIII
ENTRY INTO FORCE

This Agreement will become effective on the date in which it has been signed by the parties hereto.

ARTICLE IX
AMENDMENTS AND TERMINATION

1. Amendments to this Agreement shall be agreed by mutual consent of the parties through an exchange of letters.

2. This Agreement may be terminated at any time by the Government Party by giving a sixty-day written notice to FAO, provided that the terms of any ongoing project agreement are respected for their agreed duration.

3. This Agreement may, at any time, be terminated by FAO by written notice to the other party if FAO considers that it is no longer in a position to carry out its obligations under this Agreement.

[1] The present Framework Agreement may be concluded by or on behalf of any developing Member Nation of FAO that wishes to participate in the FAO scheme of technical cooperation among developing countries, whether as a country requesting assistance ("the Beneficiary Government") or as a country providing the expert services required ("the Releasing Government") and FAO.

Subject to the approval of the two Governments concerned, this Agreement could also be applicable to relations between a country in transition and a developing country.
