MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE REPUBLIC OF INDIA ON COOPERATION IN THE FIELD OF HEALTH AND MEDICINE

The Government of the Republic of the Philippine and the Government of the Republic of India, hereinafter jointly referred to as "Parties",

Realizing the necessity of further developing the state of health of the people of the two countries through joint efforts;

Recognizing the importance of co-operation in the field of health in the context of bilateral relations;

Have reached the following understanding:

ARTICLE 1

The Parties shall encourage cooperation in the fields of Health and Medicine on the basis of equality, reciprocity and mutual benefit.

ARTICLE 2

The Parties shall encourage collaboration on the following areas of cooperation, which include, among others:

1. Drugs & Pharmaceutical products
2. Medical Consumable products
3. Medical Education
4. Medical Equipments
5. Public Health
6. Communicable Disease Control & Surveillance
7. Hospital Management
8. Health Tourism
9. Traditional and Alternative Medicine

ARTICLE 3

Cooperation between the Parties will take the following forms:

a) Exchange of information in the field of health and medicine;
b) Exchange of health/medical experts;
c) Exchange visits of medical mission teams;
d) Training in the mutually agreed upon and identified areas referred to in Article - 2;
e) Deputation of experts to attend International meetings held In either country;
f) Conducting symposia, academic meetings and working meetings.

ARTICLE 4

Each party shall provide the receiving country with the proposal for the visit in connection with Articles 2 and 3, and accompanied by copies of curriculum vitae of the experts at least 3 months in advance. The receiving country shall convey its answer to the proposal within a reasonable time.

ARTICLE 5

The sending country shall shoulder the travel expenses of experts to and from the capital city of the receiving country. The receiving country shall be responsible for the expenses for domestic transport, food, accommodation, medical care and incidental expenses in connection with the visit.

ARTICLE 6

A "Working Group" will be established to further elaborate the details of cooperation and to oversee the implementation of this Memorandum of Understanding. The "Working Group" will meet for at least once a year, alternately in India and in the Philippines.

The composition of the "Working Group" and venue for its meetings will be agreed upon mutually by the Parties.

ARTICLE 7

The Department of Health of the Republic of the Philippines and the Ministry of Health and Family Welfare of the Republic of India shall be the designated agencies for the implementation of this Memorandum of Understanding.

ARTICLE 8

This Memorandum of Understanding shall enter into force on the date of signature and shall remain valid for a period of five (5) years. Thereafter, it shall be automatically extended for similar period(s) unless either Party notifies the other in writing, six (6) months prior to the intended termination.

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Memorandum of Understanding in two originals copies, in English and Hindi both text being equally authentic. In case of divergence of interpretation, the English text shall prevail.

Done at New Delhi on the 5th day of October in the year Two Thousand and Seven.
