THE TENTH PROTOCOL ON SCIENTIFIC AND TECHNOLOGICAL COOPERATION BETWEEN THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA AND THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES

1. In accordance with the Agreement on Scientific and Technological Cooperation between the Government of the People's Republic of China and the Government of the Republic of the Philippines signed in Manila on March 14, 1978, the Sino-Philippine Joint Committee on Scientific and Technological Cooperation {hereinafter referred to as the Joint Committee) held its tenth session in Beijing, China, on June 23-26, 1994. The Chinese Delegation (hereinafter referred to as "the Chinese side") was headed by Mr. Han Deqian, Vice Chairman of the State Science and Technology Commission (SSTC) while the Philippine Delegation (hereinafter referred to as "the Philippine side" ) was headed by Dr. Federico Macaranas, Undersecretary of the Department of Foreign Affairs (DFA). Members of the Joint Committee attending this Session are listed in Annex I.

2. The Joint Committee adopted the following agenda:

(1) Opening Ceremony
Opening Statement by Head of the Chinese
Delegation
Opening Statement by Head of the
Philippine Delegation

(2) Adoption of Agenda

(3 ) Review of the Cooperation Program Adopted at the Ninth Session of the Joint Committee

(4) Deliberation and Adoption of New Items Proposed
by the Chinese Side

(5) Deliberation and Adoption of New Items
Proposed by the Philippine Side

(6) Discussion on Expansion and Furtherance of
the Sino-Philippine Scientific and Technological
Cooperation Programs in the Future

(7) Discussion on Date and Place for the Eleventh
Session of the Joint Committee

(8) Other Matters

(9) Adoption of the Tenth Protocol

(10) Signing and Closing Ceremony

3. The two sides reviewed the implementation of scientific and technological cooperation programs for the period 1991-1993 and exchanged views on further development and cooperation between the two countries.

4. As a result of friendly consultations, the two sides deliberated and adopted programs of cooperation for 1994-1996 as follows:

(1) 7 items proposed by the Philippine side, as listed in Annex II.

(2) 3 items proposed by the Chinese side, as listed in Annex III.

(3) 11 items proposed for implementation by both sides, as listed in Annex IV.

5. As a result of consultation, it was agreed that the party which sends the study groups/experts shall bear the travel expenses of such groups/experts to and from the country of the receiving party. The receiving party shall bear the expenses for the food, accommodation, medical care and internal transport of such groups.

6. The two sides agreed that projects and/or activities that may be proposed by either side in the course of implementing this Protocol may, by mutual agreement, through diplomatic channels, be implemented in the 1994-1996 programme period and shall be included for record purposes in the Protocol of the next negotiations.

7. The two sides agreed that the communications pertinent to the approved projects in Annexes II , III and IV would be coordinated through the Department of Foreign Affairs of the Republic of the Philippines (DFA) . and the State Science and Technology Commission (SSTC) of the People' s Republic of China.

8. The State Science and Technology Commission (SSTC) of the People's Republic of China would invite the participants from the Philippines to take any of the international training courses held by SSTC in China during 1994-1996. The State Science and Technology Commission of the People's Republic of China would provide full board, lodging and local transportation for the participants from the Republic of the Philippines. The list of the training courses would be provided in due time through diplomatic channels.

9. Both sides agreed to explore the possibilities of long-term projects of joint research and development leading to commercialization in such areas as:

(1). Agriculture

(2). Laser Technology application

(3). Seismic, volcano monitoring and forecast

(4). Environmental protection and Natural resources conservation

(5). Small farm machinery

(6). Flood control and disaster reduction

(7). Sino-Philippine traditional medicine

(8). Food processing technology, particularly food preservation

(9). Tropical crops joint research and exploitation

(10). Freshwater aquaculture

10. To ensure the smooth and effective implementation of the agreed projects, both sides agreed to exchange missions to monitor and evaluate the implementation of the projects in this Protocol.

11. It was agreed that the Eleventh Session of The Joint Committee would be held in Manila in 1996, the date to be determined through diplomatic channels.

The Session was held in an atmosphere of friendship and cordiality which characterized the friendly relations between the two countries.

Annexes I, II, III and IV should form an integral part of this Protocol.
Done in Beijing, China in duplicate in English, on June 24th, 1994, both being equally authentic.
