AGREEMENT WITH HUNGARY ON DIPLOMATIC PASSPORTS

Excellency,

I have the honour to acknowledge receipt of your Excellency's Note of even date, which reads as follows:

"Excellency,

I have the honour to propose that, in the interest of strengthening friendly relations and facilitating travel of citizens who are holders of diplomatic and service/official passports, of the Republic of the Philippines and the Republic of Hungary, the following provisions governing their navel to each other's country be adopted:

1. Holders of diplomatic and service official passports of either Party shall be permitted to enter at border-crossing points open for international passenger traffic, to transit through or to temporarily stay in the territory of the other Party for a period not exceeding ninety days without a visa. Such period of stay may upon request of the competent Embassy be extended in justified cases.

2. (a) Holders of diplomatic and service/official passports of either Party who are members of the diplomatic or consular mission in the territory of the other Party shall be exempt from visa requirements to enter into the latter's territory and stay there until the end of their assignment.

(b) Provisions of paragraph (a) apply to citizens of both Parties who are representatives of one Party to an international organization which has its headquarters in the territory of the other Party or are employed by such an organization, if they are holders of diplomatic or service/official passports.

(c) For the duration of the assignment of the persons mentioned in paragraphs (a) and
(b), members of their family forming part of the household shall also be exempt from the visa requirement, if they are themselves holders of diplomatic or service/official passports.

3. This Agreement does not exempt holders of diplomatic and service/official passports from the obligation to comply with laws and regulations of both Parties on entrance, stay and exit of foreigners.

4. For reasons of public order and safety either Party may in whole or in part suspend temporarily the application of this Agreement. Such suspension or rescission of the suspension shall be notified through diplomatic channels without delay.

5. The Parties shall convey to each other within thirty days of signature of this Agreement specimens of then-diplomatic and service/official passports. The Party that subsequently modifies its diplomatic or service/official passports or introduces new diplomatic or service/official passport shall convey specimens of those passports to the other Party at least thirty days before such modification or introduction takes effect.

6. This Agreement shall enter into force on the ninetieth day from the date of its signature. This Agreement may be terminated by either Party by written notification through diplomatic channels. Such termination shall be effective ninety days after the receipt of the written notification.

If your Excellency agrees with the proposals contained in paragraphs 1 to 6 above, this Note and your Excellency's Note in reply thereto expressing your Government's agreement shall constitute an Agreement between our two Governments, which shall enter into force on the ninetieth day from the date of its signature as provided for in paragraph No. 6.

I avail myself of this opportunity to renew to Your Excellency the assurances of my highest consideration."

I am pleased to inform Your Excellency that the proposals set forth in your above-quoted Note are acceptable to my Government and that my Government agrees that your Note together with this reply shall be regarded as constituting an Agreement between our two Governments, which shall enter into force on the ninetieth day from the date of the signature as provided for in paragraph No. 6.
I avail myself of this opportunity to renew to Your Excellency the assurances of my highest consideration.
