PROTOCOL ON CULTURAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM

The Government of the Republic of the Philippines and the Government of the Socialist Republic of Vietnam as "Parties":

DESIRING to strengthen cultural cooperation between the two Parties;

RECOGNIZING the Cultural Agreement between the Government of the Republic of the Philippines and the Government of the Socialist Republic of Vietnam signed in Hanoi on 28 March 1994;

HAVE AGREED as follows:

ARTICLE 1

Both Parties shall encourage and support the participation of their respective artists in the festival of each country. The Philippines is willing to host a Vietnamese delegation during the National Arts Month organized annually in the Philippines.

ARTICLE 2

Both Parties will support each other in the celebration of each other's National Day in the country of the other, so that the people of the other country may appreciate deeper the history and tradition as well as contemporary cultural expressions of the other through cultural and art troupe exchanges.

ARTICLE 3

During the effective time of this Protocol, both Parties will exchange visits of artisans or folklorists to introduce, perform and cooperate in displaying, exhibiting some traditional art forms in one (1) week time.

ARTICLE 4

Both Parties will exchange information materials, publications and other documentation in the field of culture and arts.

ARTICLE 5

Both Parties will exchange working visits of managers working in the field of culture and arts.

ARTICLE 6

Both Parties will exchange expert teams in the field of archaeology, museum, library and archive in the form of seminars, conferences or discussions.

ARTICLE 7

Both Parties will exchange experts of training, lecturing culture and arts in the correlative forms of specialties. Exhibitions of paintings, books, handicrafts and performing arts shall be organized parallel with lectures or forums to enhance the effectiveness and stress more on the content of these activities.

ARTICLE 8

Both Parties will encourage and support exchanges and collaboration among filmmakers and distributors in cinema and television industry between the two countries. This collaboration may be concretized in a co-production either of a documentary or feature film or a television serial.

ARTICLE 9

The financial terms of the implementation of the present Protocol will be regulated on the basis of reciprocity as follows: the sending country will shoulder the international traveling expenses of its delegations to and from the receiving country, carnage and cost of medical insurance; the receiving country will shoulder the cost of hospitality, local transportation, board and lodging, venues for performance, technical, labor and other organizing costs. The Parties shall also provide proper security arrangements for exchanging cultural activities including security for props and exhibit items at the venues.

Both Parties shall discuss and come to an agreement about financial terms at least three (3) months before exchanging activities.

ARTICLE 10

This Protocol shall come into effect on the date of signature and remain for a period of five (5) years and shall be automatically renewed for every successive period of five (5) years. Any supplement and amendment of this Protocol shall be settled upon the agreement of both Parties.

Any disputes or differences arising out of the interpretation or implementation of this Protocol shall be settled amicably through consultations and negotiations between the two Parties.

Done in duplicate, in Manila on 9 August 2007 in the Vietnamese and English languages, all texts being equally authentic.
