AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM CONCERNING COOPERATION IN THE FIELD OF TOURISM

The Government of the Republic of the Philippines and the Government of the Socialist Republic of Vietnam, hereinafter referred to as "the Contracting Parties",

DESIRING to strengthen the friendly relations and mutual understanding existing between their respective countries,

RECOGNIZING the common interest of both countries to establish cooperation in the field of tourism,

RECOGNIZING further the importance of tourism in the enhancement of knowledge and understanding between the people of the two countries and as an essential element for economic development of both countries,

AND PURSUANT to the Agreement on Economic, Scientific and Technical Cooperation between the Government of the Republic of the Philippines and the Government of the Socialist Republic of Vietnam signed on 9th January 1978,

HAVE AGREED AS FOLLOWS:

ARTICLE 1

The Contracting Parties shall, subject to the laws and regulations of the respective countries, promote and develop cooperation in the field of tourism on the basis of reciprocity and mutual benefit for both countries.

ARTICLE 2

The Contracting Parties shall encourage and promote individual or group travel by their respective citizens and citizens of third country to the Philippines and Vietnam.

ARTICLE 3

The Contracting parties shall authorize their following competent agencies to implement this Agreement:

- The Philippine Party : Department of Tourism

- The Vietnamese Party : Vietnam National Administration of Tourism

ARTICLE 4 

The Contracting Parties shall encourage the exchange of experience in all matters relating to the organization, management and business operation of tourism in their respective countries and the exchange of publication, study materials and other information relating to tourism.

ARTICLE 5

The Contracting parties shall endeavour to promote technical assistance in the field of tourism through the exchange of experts and the training of personnel. The terms and conditions of such technical assistance shall be the subject of specific arrangement to be mutually agreed upon by the Contracting parties in a written Agreement on the basis of and within the framework of this Agreement.

ARTICLE 6

In conformity with their respective national laws, each Contracting Party shall endeavor to establish in its territory the tourism representative office of the other Contracting Party for the purposes of tourism.

ARTICLE 7

Either Contracting party may request in writing, through diplomatic channels, a revision or amendment of all or part of this Agreement. Any revision or amendment which has been agreed to by the Contracting parties shall come into effect on a date to be mutually agreed upon and shall accordingly form part of this Agreement.

ARTICLE 8

Any difference or dispute arising out of the implementation or application of the provisions of this Agreement shall be settled amicably by consultation or negotiation between the Contracting parties without reference to any third party or international tribunal.

ARTICLE 9

1. This Agreement shall enter into force on a date to be mutually agreed upon by the Contracting Parties which shall be notified through the exchange of Diplomatic Notes. It shall be in force for a period of 5 (five) years and shall remain in force until such time it is terminated by either Contracting party by giving to the other notice in writing, through diplomatic channel, of its intention to terminate the Agreement, at least six months prior to the intended date of termination.

2. It is understood that, at the time this Agreement enters into force, the Contracting Parties shall be in a position under its domestic laws to give effect to the provisions of this Agreement.

3. Notwithstanding the termination of this Agreement in accordance with paragraph 1, it shall continue to apply in respect of any Agreement or Contract which has been concluded thereunder until it has been fully executed unless the Contracting parties agree otherwise.

IN WITNESS WHEREOF, the Undersigned being duly authorized by their respective Governments, have signed the present Agreement.

DONE in Hanoi, Socialist Republic of Vietnam on this 28th day of March in four original texts, two each in English and Vietnamese, all texts being equally authentic. In case of differing interpretations, the English text shall prevail.
