CULTURAL AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM

The Government of the Republic of the Philippines and the Government of the Socialist Republic of Vietnam;

Desirous of strengthening the spirit of cooperation and friendship existing between the two countries;

Mindful of the valuable cultural exchanges which have developed between the two countries; Inspired by the need and common desire to promote and develop cultural relations between their respective peoples;

Have agreed as follows:

ARTICLE 1

The two Governments shall promote cultural collaboration between the two countries on the basis of mutual respect for their sovereignty and in conformity with the laws and regulations in force in each country, having in mind the interests of their respective peoples.

ARTICLE 2

Each Government shall encourage in its own country an understanding and appreciation of the culture, history and general way of life of the other country by means of:

(a) the exchange of books and periodicals and other resource material dealing with history, art, literature, science and education;

(b) the exchange of cinematographic films, including those for television, dealing with history, current affairs, culture, art, science and education;

(c) the exchange of recordings for radio broadcasting programs on history, current affairs, culture, art, science and education; and

(d) the exchange of art and other cultural exhibitions and presentations.

ARTICLE 3

The two Governments shall endeavor, subject to the laws and regulations prevailing in each country, to accord each other's nationals every possible facility to ensure better understanding of their respective cultures by encouraging visits to each other's country of:

(a) professors, scholars, journalists, radio and television broadcasters, artists and representatives of social, educational and scientific institutions; and

(b) sportsmen, sporting teams and coaches.

ARTICLE 4

Each Government shall, within its available resources, encourage in its own universities and other educational institutions the study of the history, literature and other aspects of the life and culture of the other country.

ARTICLE 5

Each Government, subject to each laws and regulations, shall exert efforts to provide the nationals of the other country with scholarships for study and research in the social, scientific, technical, cultural and educational fields.

ARTICLE 6

The two Governments shall cooperate in the exchange of information on standards and on developments in their respective educational systems to assist in the interpretation and evaluation of their degrees, diplomas and certificates, for academic and, where appropriate, for professional purposes.

The two Governments shall encourage visits to each other's country of their professors and scientists for research purposes and for participation in education-related seminars, and cooperate in the exchange of textbooks and other educational publications.

ARTICLE 7

The two Governments shall consult each other to review the operation of the present Agreement and to negotiate, when deemed necessary, the implementation of the provisions of this Agreement.

The concrete projects to be implemented under the present Agreement shall be set forth in Protocols to this Agreement to be concluded between the two Governments.

ARTICLE 8

This Agreement shall come into force on the date of signature and shall remain in force for five years, and shall be renewed for another five years unless terminated by either of the Contracting Parties in writing six months before the expiration of the agreement.

IN WITNESS WHEREOF, the Undersigned, being duly authorized thereto by their respective Governments, have signed the present Agreement.

DONE in Hanoi, Socialist Republic of Vietnam this 28th day of March 1994 in four original texts, two each in the English and Vietnamese languages, all texts being equally authentic. In case of differing interpretations, the English text shall prevail.
