The Government of the Republic of the Philippines, represented by the Department of Foreign Affairs;

and

The Government of the Federative Republic of Brazil, represented by the Ministry of External Relations (hereinafter referred to as the "Parties"),

REFLECTING the desire of both countries to develop and further enhance the friendly relations between both countries;

CONSIDERING that regular consultation and an exchange of ideas on bilateral relations and international matters of mutual interest would be of reciprocal benefit;

REAFFIRMING their conviction that the further development of friendly relations and cooperation between the two countries will contribute to international peace and security by means of creating mutual confidence, understanding and cooperation in international relations;

Have agreed as follows:

ARTICLE 1

The Parties hereby establish regular bilateral consultations between the Department of Foreign Affairs of the Republic of the Philippines and the Ministry of External Relations of the Federative Republic of Brazil (hereinafter referred to as the "Consultations"), with the aim of reviewing all aspects of their bilateral relationship and to exchange views on international affairs of mutual interest.

ARTICLE 2

The Consultations shall include, inter alia, a review of the relationship in the political, economic, commercial, investment, tourism, financial, industrial, scientific, transportation, cultural, educational, social, environmental, sport, technical and technological fields.

ARTICLE 3

The Parties agree that the Consultations should be conducted in a spirit of flexibility and cooperation. The Consultations may be held annually or more frequently as deemed necessary. The level of representation, venue, dates, agenda and duration of each meeting shall be determined by mutual agreement through diplomatic channels.

ARTICLE 4

The outcome of the Consultations shall not be made public, unless otherwise agreed upon by the Parties.

ARTICLE 5

The Parties may set up working groups or expert meetings in order to discuss specific areas of common interest.

ARTICLE 6

The Memorandum of Understanding may be amended upon mutual agreement of the Parties. The amendments shall enter into force upon signature.

ARTICLE 7

The present Memorandum of Understanding shall enter into force on the date of its signature and shall remain in force unless one of the Parties expresses its intention to terminate it, through diplomatic channels. Termination will be effective six months after the date of receipt of the notification.

ARTICLE 8

The termination of the present Memorandum of Understanding shall not affect the execution and duration of any activity resulting from this Memorandum of Understanding.

MEMORANDUM DE ENTENDIMENTO PARA O ESTABELECIMENTO DEUM MECANISMO DE CONSULTAS BILATERAIS ENTRE O GOVERNO DA REPUBLICA DAS FILIPINAS E O GOVERNO DA REPUBLICA FEDERATIVA DO BRASIL

O Governo da Republica Federativa do Brasil, representado pelo Ministerio das Reiacoes Exteriores

O Governo da Republica das Filipinas, representado pelo Departamento dos Negoctos Estrangeiros (doravante denominados as "Partes"),

REFLETINDO o desejo de ambos os paises de desenvolver e promover crescentemente as relagoes de amizade entre ambos os paises;

CONSiDERANDO que a consulta regular e o intercambio de ideias sobre as relagoes bilaterais e assuntos internacionais de interesse mutuo poderiam ser de reciproco beneficio;

REAFIRMANDO sua convicgao de que a promocao -do desenvolvimento de relagoes de amizade e cooperagao entre ambos os paises contribuira para a paz e a seguranga internacional por meio da criagao de confianga mutua, entendimento e cooperagao nas relagoes internacionais;

Chegaram ao seguinte entendimento:

ARTIGO 1

As Partes por este instrumento, estabelecem consultas bilaterais regulares entre o Departamento dos Negocios Estrangeiros da RepubHca das Filipinas e o Ministerio Relagoes Exteriores da RepubHca Federativa do Brasi! (doravante denominadas "Consultas"), com o objetivo de rever todos os aspectos de suas relagoes bilaterais e intercambiar pontos de vista sobre temas internacionais de interesse mutuo.

ARTIGO 2

As Consultas incluirao, inter alia, revisao das relagoes nos campos politico, economico, comercial, de investimentos, de turismo, financeiro, industrial, cientifico, de transporte, cultural, educacional e tecnologico.

ARTIGO 3

As Partes concordam que as Consuitas deverao ser conduzidas com urn espirito de flexibilidade e cooperacao. As Consuitas poderao ser realizadas anualmente ou com maior frequencia se considerado necessario. 0 nivei de representacao, local, datas, agenda e duragao de cada reuniao serao determinados de comum acordo peios canais diplomaticos.

ARTIGO 4

Os resultados das Consuitas nao deverao ser levados a publico, a menos que as Partes decidam de outra maneira.

ARTIGO 5

As Partes poderao estabelecer grupos de trabalho ou organizar encontros de especialistas a fim de discutir campos especificas de interesse comum.

ARTIGO 6

Este Memorandum de Entendimento podera ser modificado mediante consentimento mutuo das Partes. As Emendas entrarao em vigor no ato de sua assinatura.

ARTIGO 7

O presente Memorandum de Entendimento entrara em vigor na data de sua assinatura e permanecera valido, a menos que uma das Partes manifeste, por via diplomatica, sua intencao de denuncia-lo. A denuncia surtira efeito seis meses apos a data do recebimento da notificagao.

ARTIGO 8

A denuncia do presente Memorandum de Entendimento nao afetara a execugao e a duragao de qualquer atividade decorrente do Memorandum de Entendimento.
