MEMORANDUM OF UNDERSTANDING
1. This Memorandum sets out the understandings reached between the Government of the Republic of the Philippines and the Government of New Zealand concerning the deployment of a New Zealand Special Air Service contingent in the Philippines for the purposes of the Special Warfare exercise 1982.
2. a. The provisions contained in Annex A to this Memorandum will apply to the New Zealand force present in the Philippines for the Special Warfare exercise.
b.The provisions contained in Annex B to this Memorandum will apply to operational matters relating to the deployment of the New Zealand force during the Special Warfare exercise.
c.The provisions contained in Annex C to this Memorandum will apply to:
3. For the purposes of this Memorandum, or in its Annexes, the terms used therein will, unless the context otherwise requires, have the following meanings respectively assigned to them:
4. This Memorandum and its Annexes will take effect from 8 February 1982, and will remain in force until 180 days after the date on which one party gives notice in writing to the other party of its intention to terminate the Memorandum.

2. a. The provisions contained in Annex A to this Memorandum will apply to the New Zealand force present in the Philippines for the Special Warfare exercise.
b.The provisions contained in Annex B to this Memorandum will apply to operational matters relating to the deployment of the New Zealand force during the Special Warfare exercise.
c.The provisions contained in Annex C to this Memorandum will apply to:
(i)The settlement of claims against the Government of New Zealand or the members of the New Zealand force in respect of acts or omissions of those members; and
(ii)The settlement of claims against the Government of the Philippines by the Government of New Zealand.
3. For the purposes of this Memorandum, or in its Annexes, the terms used therein will, unless the context otherwise requires, have the following meanings respectively assigned to them:
a.'The Philippines' means the Republic of the Philippines and when used in a geographical sense means the national territory comprising the Republic of the Philippines.
b.'New Zealand authorities' means the authorities empowered by the law of New Zealand to exercise command or jurisdiction over members of the New Zealand forces.
c.'New Zealand force means the members of the NZ SAS stationed in the Philippines for the purposes of Special Warfare exercise.
d.'The Philippine authorities’ means the authority or authorities from time to time authorized or designated by the Government of the Philippines for the purpose of exercising the powers in relation to which the expression is use.
e.'NZ SAS' means New Zealand Special Air Service.
f.'SNB' means Subic Naval Base.
g.'SUBCO' means the Subic Naval Base Command of the Philippines.
h.'COMSUBCOM' means the Commander of Subic Naval Base Command
i.'PAF' means Philippine Air Force
j.'PN' means Philippine Navy
k'USAF' means United States Air Force
l.'USN' means United States Navy
4. This Memorandum and its Annexes will take effect from 8 February 1982, and will remain in force until 180 days after the date on which one party gives notice in writing to the other party of its intention to terminate the Memorandum.
