*MEMORANDUM OF UNDERSTANDING BETWEEN THE PHILIPPINE SPORTS COMMISSION OF THE REPUBLIC OF THE PHILIPPINES AND THE MINISTRY OF YOUTH AND SPORTS OF THE PEOPLE'S REPUBLIC OF BANGLADESH ON SPORTS COOPERATION

The PHILIPPINE SPORTS COMMISSION OF THE REPUBLIC OF THE PHILIPPINES and the MINISTRY OF YOUTH AND SPORTS OF THE REPUBLIC OF BANGLADESH and (hereinafter referred to as the "Participants");

DESIRING to strengthen and develop bilateral relations between their countries by promoting and increasing cooperation in the field of sports;

CONSIDERING the experience to be gained and benefits to be derived from mutual cooperation in sports;

PURSUANT to the prevailing laws and regulations as well as policies of the respective countries;

HAVE REACHED THE FOLLOWING UNDERSTANDING;

PARAGRAPH 1
 
OBJECTIVE

This MOU will provide a framework for cooperation between the Participants in the field of sports, on the basis of reciprocity and mutual benefit.

PARAGRAPH 2

AREAS OF COOPERATION

The Participants will cooperate in the following areas:

     
  1. Sports education;
  2.  
  3. Recreation and achievement in sports;
  4.  
  5. Sports science, including sports medicine and anti-doping measures;
  6.  
  7. Sports equipment;
  8.  
  9. Sports training, with particular emphasis on Special Olympics;
  10.  
  11. Any other areas of sports as may be mutually decided.

PARAGRAPH 3

FORMS OF COOPERATION

The Participants will cooperate through: 

  1. Exchange of officials in-charge of sports policy-making with a view to disseminating and sharing their views and experiences on national and international sports affairs;
        
  2.  
  3. Exchange of sports experts, coaches, referees, specialist, entrepreneurs and athletes;
         
  4.  
  5. Participation in conferences, symposia, seminars, exhibitions, meetings and championships organized by each or both of the Participant/Participants;
       
  6.  
  7. Exchange of printed materials, data and other information on sports;
       
  8.  
  9. Organization and convening of joint sporting events between their two countries; and
         
  10.  
  11. Any other forms of cooperation as may be mutually decided.
  • PARAGRAPH 4

     

    IMPLEMENTATION

         
    1. To implement this MOU, the Participants will establish a Joint Committee composed of an equal number of representatives nominated by each Participant.
                       
      1. The Joint Committee will endeavor to meet every two (2) years, or as may be requested by a Participant alternately in the Philippines and in Bangladesh.         
      2.          
      3. The Joint Committee will be responsible for:             

                  i. Preparing plans and programs of activities of cooperation;
                  ii. Recommending new forms and areas of cooperation; and
                  iii. Other matters as may be mutually decided.

         
    2. The implementation of plans, programs, activities, as specified under this MOU will be subject to specific arrangements to be mutually decided upon by the Participant in writing.

  • PARAGRAPH 5

    FINANCIAL ARRANGEMENTS

       
    1. Unless otherwise agreed upon, such Participant will be responsible for its own cost in the implementation of this MOU.
           
    2.  
    3. Financial arrangements to cover expenses for cooperative activities under this MOU will be mutually decide upon, on a case-to-case basis and subject to the availability of funds and other resources.
         
       

    PARAGRAPH 6

    INTELLECTUAL PROPERTY RIGHTS

    If a plan, program of activity results in intellectual property, the Participants will conclude a separate arrangement for the protection of such intellectual property rights accordance with their respective laws and regulations.
     

    PARAGRAPH 7

    CONSULTATION

       
    1. The Participants will immediately consult each other to resolve any differences in the interpretation of this MOU or in the implementation of plans, programs or activities under this MOU.     
    2.  
    3. The Participants will not refer such differences to any third party or tribunal.

    PARAGRAPH 8

    AMENDMENT

    Any amendment to this MOU may be done by mutual written consent of the Parties. Such amendment will become effective in accordance with Paragraph 9 (1).

    PARAGRAPH 9

    EFFECTIVITY, VALIDITY AND TERMINATION

       
    1. This MOU will be effective upon signature;     
    2.  
    3. This MOU will be effective for five (5) years and will be renewed for a similar period, unless one Participant notifies the other in writing, through diplomatic channels, of its intention to suspend or terminate this MOU, at least three (3) months prior to the intended date of termination;     
    4.  
    5. The termination of this MOU will not affect the implementation of any on-going activities, unless both Participants mutually decide otherwise. 

    IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Government, have signed this Memorandum of Understanding;

    Signed in Manila on the 5th day of November in the year 2014 in two (2) copies in the English language.
