MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE REPUBLIC OF INDIA ON COOPERATION IN AGRICULTURE AND RELATED FIELDS

The Government of the Republic of the Philippines represented herein by the Department of Agriculture and the Government of the Republic of India, represented herein by the Ministry of Agriculture and Farmers Welfare, hereinafter referred to as the "Participants";

DESIRING to enhance the existing friendly relations between the two countries through development of cooperation in agriculture and related fields;

RECOGNIZING the advantage to be derived by their respective peoples from the implementation of such cooperation;

Have reached the following understanding:

PARAGRAPH 1: OBJECTIVE

The Contracting Participants will promote technical cooperation in agriculture through collaborative activities and exchanges.

PARAGRAPH 2: FIELDS OF COOPERATION

Joint activities will be determined by the Contracting Participants and will be implemented in conformity with the laws and policies of both countries.

Such joint activities may include the area of rice production and processing, multiple cropping system, dryland farming systems, bio-organic farming, soil and water conservation and management, soil fertility, agricultural machinery, horticulture, agro-forestry, sericulture, dairy, livestock improvement (Development of buffalo, sheep and goats, tropicalized vaccine production, animal nutrition and utilization of animal by-products), sugarcane technology, meat inspection system, post-harvest handling and processing of agricultural commodities and fishery products, integrated pest management, cotton growing technology and hybrid cotton breeding, research and development of plantation crops, fruit crops and leguminous crops, plant quarantine, research and development on bio-botanical pesticides, biotechnology, agricultural cooperatives and other fields as may be mutually jointly decided upon by both the Contracting Participants.

PARAGRAPH 3: MODE OF COOPERATION

Cooperation will be effected by means of, but not limited to, the exchange of materials and information/ technology, the exchange of scientists, experts and trainees, the organization of symposia and conferences, the joint publication of studies and papers, conduct of agricultural trade fairs and exhibitions, joint ventures, and other means as may be mutually agreed upon.

PARAGRAPH 4: JOINT WORKING GROUP

A Joint Working Group, composed of equal number of representatives, will be formed to provide guidance, review the progress of activities and to facilitate cooperation. The Joint Working Group will meet once every two years alternately in the Philippines and India.

Each Contracting Participant will designate an Executive Secretary who will be responsible for coordinating and monitoring all activities carried out under the auspices of this Memorandum. The Executive Secretaries will be permanent members of the Joint Working Group.

During the interim years, the Executive Secretaries will either meet in person or correspond to develop a work programme and coordinate administrative details.

PARAGRAPH 5: STAKEHOLDERS INVOLVEMENT

To generate broad interest, this Memorandum of Understanding authorizes the involvement of other government agencies, the scientific and business communities as well as the private sectors of both countries.

The Contracting Participants will encourage and facilitate direct contracts between these groups to work toward long-term cooperation in the areas of research, extension and training.

PARAGRAPH 6: INTELLECTUAL PROPERTY RIGHTS

Should activities give rise to intellectual property right, the Participants will, prior to carrying out any such activities, enter into separate arrangements that will specifically provide for the ownership and management of such rights.

Any result of activities which are performed under this Memorandum of Understanding shall be subject to the laws and regulations concerning the protection of Intellectual Property Rights in respective territories of the Parties.

PARAGRAPH 7: FINANCIAL ARRANGEMENT

The sending Contracting Participant shall bear the cost of its personnel engaging in the joint activities and exchange programmes which include inter-alia, international airfare, boarding board and lodging, local transportation and other necessary expenses and the receiving Contracting Participant shall make arrangements for the hiring of venue etc. for holding the meetings.

PARAGRAPH 8: COORDINATING OFFICES

Under this Memorandum, the designated coordinating offices will be the Department of Agriculture for the Government of the Republic of the Philippines, and the Ministry of Agriculture and Farmers Welfare, for the Republic of India.

PARAGRAPH 9: NATURE OF THE MOU

This Memorandum will not affect in any way, the Contracting Participants' commitments under existing bilateral agreements between the two countries.

PARAGRAPH 10: CONSULTATIONS

Any dispute between the Participants arising out of the interpretation or implementation of the MoU will be settled amicably by consultation or negotiations, through diplomatic challenges.

PARAGRAPH 11: AMENDMENT

Any amendment or revision to the text of this MoU will be done by mutual written consent of the Participants. Such amendment or revision will come into effect in accordance with the provision on entry into force.

PARAGRAPH 12: ENTRY INTO FORCE. DURATION AND TERMINATION

This Memorandum of Understanding shall enter into force on the date of its signature and shall remain in force for a period of five years, where it shall automatically be renewed for a further period of five (5) years each unless terminated by either Participant giving six (6) months’ written notice to the other Participant of its intention to terminate this Memorandum of Understanding prior to the expiration of the initial period or the expiration of each subsequent period, in case of its automatic extension.

The termination of this MoU will not affect the implementation of any ongoing activities or projects, unless both Participants mutually decide otherwise.

IN WITNESS WHEREOF the undersigned being duly authorized there to have signed this Memorandum of Understanding.

Signed at Manila on the 13th day of November in the year 2017 in two originals in English and Hindi Languages. In case of inconsistency, the text in English shall prevail.
