MEMORANDUM OF UNDERSTANDING BETWEEN THE DEPARTMENT OF SCIENCE AND TECHNOLOGY OF THE REPUBLIC OF THE PHILIPPINES AND THE STATE ATOMIC ENERGY CORPORATION «ROSATOM» (RUSSIAN FEDERATION) ON COOPERATION IN THE USE OF NUCLEAR ENERGY FOR PEACEFUL PURPOSES

 

The Department of Science and Technology of the Republic of the Philippines and the State Atomic Energy Corporation «Rosatom» (Russian Federation), hereinafter referred to as «the Participants »,

On the basis of friendly relations existing between the Republic of the Philippines and the Russian Federation,

Mindful that the Republic of the Philippines and the Russian Federation are members of the International Atomic Energy Agency and are parties to the Treaty on the Non-proliferation of Nuclear Weapons of July 1, 1968,

Acknowledging that the use of nuclear energy for peaceful purposes and assurance of nuclear and radiation safety and security are the important factors in ensuring social and economic development of both states,

Considering the intention of the Government of the Republic of the Philippines to continue developing a variety of applications of nuclear energy in accordance with its laws, rules and regulations,

Acknowledging the significant experience by the Russian Federation in developing nuclear energy within its territory as well as assisting other countries in developing their nuclear power and industrial complexes,

Have reached the following mutual understanding:

 

Paragraph I
Objective of Cooperation

The general purpose of this Memorandum of Understanding (Memorandum) is to develop the cooperation in the area of peaceful use of atomic energy between the Participants, in accordance with their domestic laws, rules and regulations, and international treaties to which the Republic of the Philippines and the Russian Federation are the State parties.

Paragraph II
Areas of Cooperation

The Participants may discuss and plan bilateral cooperation in the field of peaceful use of nuclear energy, which includes, among others, the following areas:

  1. Radioisotopes and its applications;
  2. Applications of radiation technology for agriculture, health and medicine, industry and environment etc.;
  3. Fundamental and application research activities;
  4. Nuclear safety and security, radiation protection and evaluation of e nvironmental radiological impact of nuclear energy;
  5. Construction and operation of nuclear research reactors;
  6. Enhancement of public awareness of nuclear energy in the Republic of the Philippines based on the Russian and worldwide experience;
  7. Supply of equipment, nuclear material and provision of services in the
    field of nuclear fuel cycle;
  8. Spent nuclear fuel and radioactive waste management;
  9. Research and training on construction and operation of nuclear power plants;
  10. Development of nuclear infrastructure in accordance with international recommendations and on the basis of Russian experience including education,
    training and qualification enhancement of managerial and engineering personnel.

 Paragraph III
Forms of Cooperation

The cooperation in the areas envisaged in Paragraph II of this Memorandum could be implemented in the forms as follows:

  1. Establishment of joint working groups for performance of specific projects and scientific research;
  2. Exchange of experts;
  3. Arrangement of workshops and symposia;
  4. Assistance in training and education of research and engineering personnel;
  5. Exchange of scientific and technical information.

Each Participant will designate an authorized organization for implementing of this Memorandum. For the Russian Participant the authorized organization will be the State Atomic Energy Corporation «Rosatom». For the Philippine Participant the authorized organization will be the Philippine Nuclear Research Institute.

Paragraph IV
Intergovernmental Agreement

The Participants will make efforts to develop and sign an Agreement between the Government of the Republic of the Philippines and the Government of the Russian Federation on cooperation in the use of nuclear energy for peaceful purposes.

Paragraph V
Coordination

The Participants will establish a Joint Working Group to define the specific joint projects that are of common interest. Each Participant will appoint a Coordinator for management of the activities in the framework of the Joint Working Group. The Coordinators will perform the functions of the key contact persons for each of the Participants, responsible for all information exchange with respect to the mechanisms of cooperation to be implemented through them.

 Paragraph VI
Legal Obligations

This Memorandum is not an international treaty and does not set any legal rights and obligations, regulated by international or national law.

Paragraph VII
Amendments

Any amendment or revision of this Memorandum will be done in writing by mutual consent of the Participants through diplomatic channels. Such amendment will be applied in accordance with the provisions of Paragraph VIII.

 Paragraph VIII
Final Provisions

This Memorandum will be applied from the date of last written notification by the Participants, through diplomatic channels, indicating that their domestic requirements for its applicability have been completed.

This Memorandum will be applied for the period of 5 years and will be renewed for a similar period, unless one Participant notifies the other in writing through diplomatic channels of its intention to terminate this Memorandum, at least ninety (90) days prior to the intended date of termination.

Signed in Moscow on 25 May 2017 in duplicate in the English and Russian languages. In case of divergences, the English text will be used.
