AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE KINGDOM OF THAILAND FOR COOPERATION IN THE FIELD OF SCIENCE AND TECHNOLOGY

The Government of the Republic of the Philippines represented by the Department of Science and Technology (DOST); and the Government of the Kingdom of Thailand represented by the Ministry of Science and Technology (MOST), hereinafter referred to as "the Parties",

Desirous of developing cooperation between the two countries particularly in the field of science and technology,

Conscious of mutual benefit to the two countries derived from the development of their scientific and technological relations,

Taking account of the fact that the implementation of such cooperation will contribute to the development of mutual understanding between the DOST and MOST and to the growing friendly relations between the two countries,

Have agreed as follows:

 

ARTICLE 1
OBJECTIVE

 

The Parties shall promote the development of scientific and technological cooperation between the two countries in spheres of mutual interest on the principle of equality and mutual benefit.

On mutual consent, the Parties shall define the areas of such cooperation.

 

ARTICLE 2
FORMS OF COOPERATION

  1. Scientific and technological cooperation will be carried out in the following basic forms:

    a. Joint research and development;
    b. Exchange of scientists, specialists and representatives of academic, research, industrial and trade organizations interested in scientific and technological cooperation;
    c. Exchange of technical documentation and information;
    d. Arrangement of bilateral conferences and symposia on subjects of mutual interest; and
    e. Other forms of cooperation in the field of science and technology

  2. The present Agreement does not exclude the visits and exchanges of specialists in the area of science and technology outside the programmes of scientific and technological cooperation agreed upon under the present Agreement.

 

ARTICLE 3
IMPLEMENTATION

  1. To implement this Agreement, representatives of the Parties shall meet, whenever necessary, to negotiate the programmes and approve the areas and terms of scientific and technological cooperation, the ways and means for accomplishing the agreed items of the programmes and to discuss other issues relative to the present Agreement.

  2. The Parties shall encourage the establishment of scientific and technological contacts between the appropriate organizations, agencies, universities and firms in both countries and, as mutual needs arise, the conclusion of implementing arrangements. Such implementing arrangements shall be concluded in accordance with the laws and regulations of the two countries.

 

ARTICLE 4
DISPUTE RESOLUTION

Any dispute between the Parties arising out of the interpretation or implementation of the Agreement shall be settled amicably by consultations or negotiations, through diplomatic channels.


ARTICLE 5
AMENDMENT

Any amendment or revision to the text of the Agreement shall be done by mutual consent of the Parties. Such amendment or revision shall enter into force in accordance with the provision on entry into force.


 
ARTICLE 6
ENTRY INTO FORCE, DURATION AND TERMINATION

This Agreement shall enter into force on the date of later written notification by either the Parties, through diplomatic channels, indicating that the domestic requirements for its entry into force have been completed. It shall be valid for a period of five (5) years and shall continue in force thereafter, unless terminated by either government through a six-month prior written notice.


IN WITNESS WHEREOF, the undersigned, being duly authorised thereto by their respective Governments have signed the present Agreement.
