AGREEMENT ON CULTURAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF BURKINA FASO
The Government of the Republic of the Philippines and the Government of Burkina Faso, hereinafter referred to as the Parties;
Desirous of strengthening friendly relations and promoting a deeper understanding of each other's culture and people;
Acknowledging that culture and the arts are vital components of development and that cooperation in these fields enhances institutional networking and people-to-people exchanges;
Recalling the Convention for the safeguarding of the intangible Cultural Heritage (2003) signed under UNESCO and ratified by both Parties in 2006;
Have agreed on the following:
ARTICLE 1
General Objectives
General Objectives
The Parties agree to promote the development of mutually beneficial relations in the fields of culture and the arts on the basis of mutual respect for sovereignty and the laws and regulations of each country, and bearing in mind the interest of their respective peoples.
ARTICLE II
Scope of Cooperation
Scope of Cooperation
The Parties shall promote and enhance knowledge and understanding among their respective peoples in the artistic and cultural education, performing arts, visual arts, literary arts, cinema and audio visual, tangible and intangible cultural heritage, and other forms of expression, activities and events of each other's country through the succeeding provisions.
ARTICLE III
Networking and Exchanges
Networking and Exchanges
1. The Parties shall promote networking, exchanges, and reciprocal access between cultural agencies, libraries, museums, archives, and other establishments and institutions.
2. The Parties shall encourage both in the public and private sectors, reciprocal visits of cultural officials, artists, experts, students and professionals, for research, training, performances, exhibitions, and participations in cultural and artistic activities.
3. The Parties shall promote the establishment of bilateral agreements between creative organizations and cultural institutions on matters of mutual interest.
ARTICLE IV
Dissemination of Information
Dissemination of Information
1. The Parties shall endeavor to promote networking and exchanges between libraries, museums, archives, cultural agencies, and other establishments from both the public and private sectors.
2. The Parties shall encourage the dissemination of each other's literary, musical and artistic works, tradition arts and crafts.
3. The Parties shall exchange books, periodicals, magazines, and other information materials including multi-media products on culture and the arts.
ARTICLE V
Implementing Arrangements
Implementing Arrangements
The Parties may enter into subsequent programs of cooperation of detailing the specific arrangements for the implementation of this Agreement.
ARTICLE VI
Settlement of Dispute
Settlement of Dispute
Any dispute between the Parties that may arise out of the interpretation or implementation of this Agreement shall be settled amicably through consultations or negotiations through diplomatic channels.
ARTICLE VII
Conformity with Laws and Regulations
Conformity with Laws and Regulations
The Provisions of this Agreement shall be in conformity with existing laws and regulations in the Parties' respective countries
ARTICLE VIII
Entry into Force
Entry into Force
This Agreement shall enter into force on the date of the later written notification by the Parties, through diplomatic channels, indicating that the domestic legal requirements for its entry into force have been complied with.
ARTICLE IX
Validity and Duration, Amendment and Termination
Validity and Duration, Amendment and Termination
1. The Agreement shall remain in full force and effect unless a Party notifies the other Party, through diplomatic channels, of its desire to suspend or terminate the same. In such case, the Agreement shall remain valid for a period of sixty (60) days after the date on which one Party receives an official notification from the other Party expressing the desire of the latter to suspend or terminate the validity of this Agreement.
2. Any amendment or revision to the text of the Agreement shall be done by mutual consent of the Parties. Such amendment or revision shall enter into force in accordance with the provisions on entry into force.
3. The termination of this Memorandum of Agreement shall be without prejudice to the existing and on-going activities or projects being undertaken under this Memorandum of Agreement, unless otherwise agreed by the Parties in writing.
