EXCHANGE OF LETTERS ON CHINA AID BRIDGE & ROAD PROJECT IN MARAWI

Your Excellency,

 

On behalf of the Government of the People's Republic of China, I have the honor to confirm that our two sides have, through friendly consultations, reached the following agreement:

1. According to the Agreement on Economic and Technical Cooperation signed by the Government of the People's Republic of China and the Republic of the Philippines on November 15, 20 17, the Chinese Government agreed to provide special aid to the Philippine Government to carry out reconstruction in Marawi. Upon discussions between the two sides, the Chinese Government agrees to help the Philippines implement the Road and Bridge Project in Marawi (the Project). The Project includes the construction of a bridge, a road, and other related ancillary works. The total length of the project is about 620 meters and the length of the bridge is about 292 meters, subject to verification during the actual conduct of field investigation.

2. The Project will be implemented by the Philippine side, through its implementing agency. The Philippine side shall be responsible for providing land for construction, demolition of buildings, resettlement and relocation of affected families, and clearance of power lines and underground pipelines in the construction area. The Philippine side shall put out a tender to finish the selection of the general contractor and the survey and design company among the Chinese companies recommended by the Chinese side. The Philippine side shall sign the applicable contracts with each of them respectively. The Philippine side shall also facilitate the entry and exit procedures, and permits to stay and work of the Chinese technical and management personnel. The Philippine side shall be responsible for the daily management, repair, and maintenance after the completion of the Project. The costs incurred in the above-mentioned responsibilities of the Philippine side shall be borne by the Philippine side.

3. The Chinese side shall be responsible for reviewing the project investment based on the feasibility study report. The Chinese side shall bear the Project construction costs, survey , and design fees ; and construction supervision fee within the investment cap. The Chinese side shall also appoint the project management firms for external supervision and shall bear the corresponding costs.

4. When the Philippine side implements the Project, the total cost shall not exceed One Hundred and Twenty-Six Million and Two Hundred and Thirty Thousand Renminbi Yuan only (RMB Yuan 126,230,000), including the construction, survey , design and supervision fees. The external supervision cost of the Chinese side shall be no more than Five Million and Two Hundred Ninety Thousand Renminbi Yuan only (RMB Yuan 5,290,000).

The total expense of the above-mentioned items shall not exceed One Hundred and Thirty-One Million and Five Hundred and Twenty Thousand Remninbi Yuan only (RMB Yuan 131,520,000) which shall be disbursed through the grant under the Agreement on Economic and Technical Cooperation between the Governments of the People's Republic of China and the Republic of the Philippines signed on November 15,2017.

5. After completion of the necessary internal procedures by the Philippine side, the details on the implementation of the above-mentioned Project shall be stipulated in an agreement to be signed by the designated implementing agencies of the Governments of China and the Philippines.

If Your Excellency could kindly confirm the above with a letter of reply on behalf of the Government of the Republic of the Philippines, this letter and your letter of reply shall constitute an agreement between our two Governments.
