MEMORANDUM OF UNDERSTANDING FOR COOPERATION ON THE EXPANSION OF RENEWABLE ENERGY DEPLOYMENT BETWEEN THE DEPARTMENT OF NATIONAL DEFENSE OF THE REPUBLIC OF THE PHILIPPINES AND THE MINISTRY OF TRADE, INDUSTRY AND ENERGY OF THE REPUBLIC OF KOREA

JUNE 2018

The Department of National Defense of the Republic of the Philippines and The Ministry of Trade , Industry and Energy of the Republic of Korea (hereinafter referred to as "Participants" ) ;

Recognizing the potential for cooperation that exists in the expansion of renewable energy deployment in the Republic of the Philippines and desiring to execute mutually beneficial cooperation for the development and implementation of joint programs, have reached the following understanding:

Paragraph 1 Scope

1. This Memorandum of Understanding (hereinafter referred to as the "MOU") aims to promote cooperation between the Participants in expanding renewable energy deployment (i.e. solar PV, wind power, etc.) by utilizing the sites that are provided by the Department of National Defense of the Republic of the Philippines.

2. This MOU will be implemented within the framework of the respective domestic laws and regulations of the two countries and subject to the availability of resources and personnel of the Participants.

Paragraph 2 Forms of Cooperation

1. The Participants will cooperate in joint activities for renewable energy deployment based on faithful and sincere actions for their mutual prosperity and joint development.

2. The Korean Side will endeavor to expand the renewable energy deployment in the Philippines, including the following:

a) Encouraging Korean companies to participate m the development and implementation of joint programs; and

b) Supporting feasibility studies and providing professional advice on the implementation of joint programs.

3. The Philippines Side will endeavor to carry out the following roles for cooperation with the Korean Side:

a) Designating sites for the development and implementation of joint programs; and

b) Supporting legal and institutional procedures necessary for the implementation of joint programs.

4. The Participants will conduct joint seminars, workshops and meetings to discuss the following matters, if necessary for the implementation of joint programs:

a) Joint examination on the development and implementation status of programs;

b) The exchange of personnel and information; and

c) Other matters jointly decided upon by the Participants.

Paragraph 3 General Provisions

1. This MOU is not intended to affect the two countries' respective rights and responsibilities under international law.

2. Each Side is responsible for the costs of its own participation in all cooperative activities including joint programs carried out under this MOU unless the Participants jointly decide otherwise in writing.

Paragraph 4 Dispute Settlement

Any difference between the participants in relation to the interpretation or implementation of this MOU will be settled amicably by consultation or negotiation between the Participants.

Paragraph 5 Entry into Effect , Duration and Termination

1. This MOU will come into effect on the date of its signature by both Participants and remain in effect for a duration of three (3) years. This duration may be extended with the mutual written consent of the Participants.

2. This MOU will cease to have effect three months after one Side expresses to the other its intention to terminate this MOU in writing. In such case, the termination of this MOU will be effected without prejudice to any activities in progress under this MOU at the time, unless otherwise jointly decided by the Participants.
