MEMORANDUM OF UNDERSTANDING ON COOPERATION IN THE FIELD OF BROADCASTING BETWEEN THE PRESIDENTIAL COMMUNICATIONS OPERATIONS OFFICE OF THE REPUBLIC OF THE PHILIPPINES AND THE MINISTRY OF CULTURE, SPORTS AND TOURISM OF THE REPUBLIC OF KOREA

The Presidential Communications Operations Office (PCOO) of the Republic of the Philippines and the Ministry of Culture, Sports and Tourism (MCST) of the Republic of Korea (hereinafter referred to as the "Sides" ),

Desiring to cooperate for the purpose of mutual staff visits, training and exchange in the field of broadcasting,

Have reached the following understanding:

Paragraph 1 Objective

The objective of the cooperation under this Memorandum of Understanding (MOU) is for the Sides to enhance their capabilities in the field of broadcasting and to undertake joint or individual activities and programs that help strengthen cooperation between the Sides.

Paragraph 2 Scope and Limitations

1. Cooperation under this MOU will be focused on a list of proposed activities jointly decided upon by both Sides. The activities under the MOU will be jointly undertaken by the respective organizations or departments of the Sides involved in broadcasting.

2. The Sides understand that this MOU is preliminary in nature. The Sides will always act in good faith and pursuant to the commitments set forth in the MOU.

3. The Sides are encouraged but are not bound to enter into further arrangements upon the entry into effect of this MOU. The MOU does not preclude the Sides from entering into other agreements with other international partners for the development of similar projects.

4. Neither Side will disclose to a third party or otherwise disseminate confidential information received from the other Participant in the course of carrying out joint activities within the framework of this MOU, except where prior written permission is obtained from the other Side.

5. This MOU is not intended to create any legal obligations under international law and will be carried out within the framework of the respective laws and regulations of the two countries and subject to the availability of appropriated funds and personnel of the Sides.

Paragraph 3 Content of Cooperation

1. The Sides will create favorable conditions for the broad and free dissemination of information to further increase the knowledge and understanding about the life and culture of both countries.

2. The Sides will provide assistance In the training of personnel In the field of broadcasting and encourage cooperation between the educational and research institutions and organizations acting in this field. The Sides will also encourage the exchange of experts in the field of broadcasting and mass communication.

Paragraph 4 Dispute Settlement

If any dispute arises from the interpretation or application of this MOU, the duly authorized representatives of each Side will immediately consult each other and seek a resolution by negotiation or by any other method of dispute settlement acceptable to the Sides.

Paragraph 5 Amendments

This MOU may be amended with the mutual written consent of the Sides.

Paragraph 6 Entry into Effect, Duration and Termination

This MOU will take effect on the date of signature . It will remain in effect for a period of three years and will be automatically renewed for successive three-year periods, unless one Side officially notifies the other Side of its desire to suspend or terminate it at least three months prior to the intended suspension or termination . In such a case, the suspension or termination will take effect three months after the date on which the other Participant receives such a notice.

Signed in Seoul on the 5th day of June 2018, in duplicate in the Korean and English languages, all texts being equally valid.
