MEMORANDUM OF UNDERSTANDING FOR COOPERATION IN THE FIELD OF TECHNICAL VOCATIONAL EDUCATION AND TRAINING BETWEEN THE TECHNICAL EDUCATION SKILLS DEVELOPMENT AUTHORITY (TESDA) AND THE NATIONAL QUALIFICATIONS AUTHORITY (NQA)

The Technical Education and Skills Development Authority of the Republic of the Philippines , hereinafter referred to as TESDA,

and

The National Qualifications Authority of the United Arab Emirates hereinafter referred to as NQA,

DESIRING to strengthen existing friendly relations between the two countries through cooperation in the fields of human capacity building and employment promotion;

RECOGNIZING the benefits to be derived from such cooperation by both countries ;

SHARING the interest in human resource development especially in the areas of technical vocational education and training;

RECALLING the initial discussions of TESDA and NQA during the exchange visits in April 2015 and August 2015, respectively;

HAVE REACHED the following Understanding :

Paragraph 1

Objectives

The Participants in accordance with the laws and regulations in force in their countries will:

1 . Seek to recognize the existing technical vocational education and training qualifications framework in both countries including competency standards for existing occupations , system of training , competency assessment , quality assurance and certification;

2. Develop a mechanism by which the recognition of systems can be formalized and implemented;

3. Cooperate in planning and conducting capacity building programs ; and

4 . Upgrade the competencies of workers in both countries to improve the quality of work.

Paragraph 2

Areas of Cooperation

TESDA and NQA will work towards the promotion and cooperation in the field of technical vocational education and training through:

a. Comparability of both TVET systems in competency standards , competency assessment and competency certification;

b. Recognition of education and training credentials;

c. Capability-building programs as related to the objectives of this MOU ; and

d. Exchange of visits of vocational training instructors, experts, managers and technical staff.

Paragraph 3

Joint Working Groups

1. TESDA and NQA will establish a Joint Working Group composed of Senior Officials of both Participants . The Joint Working Group will meet every year from the signing of this MOU unless otherwise decided by the Joint Working Group.

2. The Joint Working Group will have the following responsibilities:

a . Establish a work program of cooperation activities;

b . Oversee the implementation of the agreed work program; and

c. Recommend to TESDA and NQA the recognition arrangements that will be implemented to achieve the purposes of this MOU.

3. In carrying out its responsibilities , the Joint Working Group may consult with or invite the participation of relevant public and private sectors on matters relating to the execution of this MOU.

Paragraph 4

Funding

1. Each party will fund its activities unless decided otherwise .

2 . The Joint Working Group will recommend how the cost of each program will be distributed between the two (2) Participants .

 

Paragraph 5

Limitation of Personnel Activities

Any person engaged in activities within the framework of the MOU will respect the sovereignty of the host country and will avoid any activity inconsistent with the objective of this MOU.

Paragraph 6

Amendment

This MOU may be amended by mutual written consent of both Participants. Such amendment will form an integral part of this MoU and will take into effect in accordance with the effectivity clause .

Paragraph 7

Settlement of Differences

Any differences arising from the interpretation and implementation of the MOU will be settled amicably by consultation or negotiation between both Participants.

Paragraph 8

Effectivity, Duration and Termination

1 . This MOU shall enter into force on the date of signature and shall remain in force for a period of five (5) years , unless either Participant notifies the other in writing through diplomatic channels of its intention to terminate it. Such termination shall take effect after six months of the date of the official notification of termination.

2. Unless otherwise approved by both Participants , the termination of this MOU will not affect the continuation of any on-going projects agreed by both Participants until they are completed .

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments , have signed this Memorandum of Understanding .

 

This MOU has been signed on the 9th of May, 2018 in duplicate in Abu Dhabi, United Arab Emirates , each in Arabic and English languages, and all texts are equally valid .
