EXCHANGE OF NOTES BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE UNITED STATES OF AMERICA FOR THE FINANCING OF CERTAIN EDUCA­TIONAL PROGRAMS

No. 1504 Excellency:

I have the honor to refer to our recent discussions regarding the revision of certain provisions of the agreement between our two governments regard­ing the establishment of an educational foundation and providing for the financing of certain educational exchange programs, signed on March 23, 1963. Pursuant to Article 14 thereof, I have the honor to propose the follow­ing amendments:

1. The first sentence of the first paragraph of Article 1 be amended to
read as follows:

"There shall be established a Foundation to be known as the Philippine-American Educational Foundation (hereinafter designated the 'Foundation'), which shall be recognized by the Government of the United States of America and the Government of the Republic of the Philippines as an organization created and established to facilitate the administration of the educational program provided for in the present agreement."

2. Article 3 be amended to read as follows:

"All commitments, obligations, and expenditures authorized by the Foundation shall be made pursuant to an annual budget approved by the Secretary of State pursuant to such regulations as he may prescribe."

3. The first paragraph of Article 10 be amended by substituting the period at the end of the sentence with a comma and adding:

"and contributions from the Government of the Republic of the Philippines and any other source."

Upon receipt of a note from Your Excellency indicating that the proposals contained in this note are acceptable to the Government of the Republic of the Philippines, the Government of the United States will consider that this note and your reply thereto shall constitute an agreement between the two gov­ernments on this subject, the agreement to enter into force on the date of your note in reply.

Accept, Excellency, the renewed assurances of my highest consideration.

No. 69-277 Excellency:

I have the honor to refer to Your Excellency's Note No. 1504 with regard to the revision of certain provisions of the agreement of March 23, 1963 between our two governments concerning the establishment of the educational foundation and providing for the financing of certain educational exchange programs.

I am pleased to inform Your Excellency that the proposed amendments are acceptable to the Government of the Republic of the Philippines, as fol­lows:

1. That the first sentence of the first paragraph of Article 1 on the Agreement between the governments of the Republic of the Philippines and the United States be amended to read as follows:

There shall be established a Foundation to be known as the Philippine-American Educational Foundation (hereinafter designated the Foundation), which shall be recognized by the Government of the Republic of the Philippines and the Government of the United States of America as an organization created and established to facilitate the administration of the educational program provided for in the present agreement."

2. That Article 3 be amended to read as follows:

"All commitments, obligations, and expenditures authorized by the Foundation shall be made pursuant to an annual budget approved by the Secretary of Sate pursuant to such regulations as he may prescribe."

3. That the first paragraph of Article 10 be amended by substituting the period at the end of the sentence with a comma and adding:

"and such contributions as may be received from the Government of the Republic of the Philippines and any other sources."

With respect to No. 3 above, the underlined words are the changes which have been incorporated by the Government of the Republic of the Philippines in the wording of Your Excellency's Note No. 1504.

THE AMERICAN AMBASSADOR OF THE SECRETARY OF FOREIGN AFFAIRS OF THE PHILIPPINES

Manila, March 19, 1969

No. 202 Excellency:

I have the honor to refer to Your Excellency's note of January 31, 1969, concerning an amendment to the agreement between our two Governments regarding the establishment of an educational foundation and providing for the financing of certain educational exchange programs, signed on March 23, 1963.

I desire to inform Your Excellency that the wording suggested by the Government of the Republic of the Philippines for the first paragraph of Article 10 is acceptable to my Government.

Accordingly, it is considered that my Government's note of December 11, 1968, Your Excellency's note of January 31, 1969, and the present note consti-

tute an agreement between our two Governments on this subject.

Accept Excellency, the renewed assurances of my highest consideration.
