THE IMPLEMENTATION PROGRAM OF THE TOURISM COOPERATION MEMORANDUM BETWEEN THE DEPARTMENT OF TOURISM OF THE REPUBLIC OF THE PHILIPPINES AND THE NATIONAL TOURISM ADMINISTRATION OF THE PEOPLE'S REPUBLIC OF CHINA
The Department of Tourism of the Republic of the Philippines and the National Tourism Administration of the People's Republic of China, hereinafter referred to as the Parties;
Pursuant to the Memorandum of Understanding of Tourism Cooperation between the Government of the People's Republic of China and the Government of the Republic of the Philippines signed in Beijing on September 11th, 2002, hereinafter referred to as the Memorandum, as well as previous agreements relating to the encouragement of travel and tourism between the Parties.
Desirous of realizing the broad goals stated in the said Memorandum and putting into action their common objectives.
Having agreed through mutual consultations, upon the following Implementation Program for Tourism Cooperation for 2004 to 2006, subject to the laws and regulations of each country:
ARTICLE 1
EXCHANGE OF TOURISM PROFESSIONALS AND ADMINISTRATORS
1. In the spirit of understanding, both sides shall encourage and support the exchange of their respective administrators and tourism professionals of both countries in order to strengthen the mutual development in the field of Hotel, resorts related industry and competency standards. The Chinese side shall invite a delegation of 4 to 6 members from the Philippines to visit China for a period of one week in November 2004. The Composition of this delegation shall be determined by the Philippines Side. CNTA shall prepare an appropriate program for this familiarization or observation tour on the aforesaid subject matter.
2. The Philippines Side shall invite from the Chinese Side a counterpart delegation, of the same number and for the same period of one week, at the time convenient for the Chinese Side in 2005. CNTA shall determine the composition of the said delegation and similarly, the Philippines Side shall prepare an appropriate program for the delegation.
3. The Parties shall conduct similar exchanges in 2006. CNTA agrees to invite another set of delegation from the Philippines in November 2005 while the Philippines agrees to invite Chinese Counterpart delegation at the time convenient for the Chinese Side in 2006
ARTICLE 2
JOINT PROMOTION
1. The Parties shall, in accordance with the situation, choose the common market for both Sides to launch joint promotion, request their respective overseas offices to provide necessary materials to each other and hold joint activities when necessary. The detailed arrangement of the joint promotion shall be decided by mutual consultation.
2. The Parties encourage travel agencies to promote the other's products.
ARTICLE 3
LANGUAGE AND CULTURAL TRAINING
The Chinese Side shall assist the Philippines Side, by sending qualified instructors in Mandarin and tour guide to conduct courses in the Philippines as part of the training of local guides who will cater to Chinese tourists. The Chinese Side shall consider conducting workshops in the Philippines by sending instructors to orient the tour operators on the proper handling of Chinese tourists. The Philippines side shall consider conducting workshops in China to the tour operators on the Philippines' culture and tradition, especially on the long standing historical ties between the two countries, to better foster interest in the Philippines. The detailed arrangement of the above-mentioned trainings and workshops shall be decided through mutual consultation.
ARTICLE 4
TOURISM INVESTMENT
Both sides, in accordance with the current laws and regulations of each country, shall encourage the tourism investment in the other's country.
ARTICLE 5
OTHER MATTERS
1. A working group shall be set up by the Parties to implement this Program. Any problem which is not determined in this Program shall be solved through mutual consultation through the communication of the working group.
2. Should it be any necessity to amend this Program during the implementation, consultations shall be conducted by the Parties.
3. The Implementation Program shall enter into force on the date of signature.
Done in Beijing on September 1st, 2004, in English and Chinese version, both languages being equally authentic.
