AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN ON COOPERATION IN THE FIELD OF TOURISM

The Government of the Republic of the Philippines and the Government of the Republic of Kazakhstan, hereinafter referred to as the Parties, desiring to strengthen the friendly relations and mutual understanding between the two countries, for the development of tourism on the basis of equality and mutual benefit, have agreed as follows:

ARTICLE 1

The Parties shall create favourable conditions for the development of long-term cooperation in the field of tourism on the basis of equality and mutual benefit of the states of the Parties.

ARTICLE 2

The Parties shall, in accordance with the legislations of their states, encourage the application of simple frontier and customs procedures for citizens of the states of the Parties travelling between the two countries for tourism purposes.

ARTICLE 3

The Parties shall encourage investments in the tourism industry, including investments in activities of private enterprises, in accordance with the national laws of the states of the Parties.

ARTICLE 4

The Parties, in accordance with national laws of their states, shall encourage the realization of coordination of tourism activities between the authorized organs of the states of the Parties by exchanging information, expertise, and experience regarding management of tourism resources, effectual legislation on tourism activities, and measures for preservation as well as sustainable development of both natural and cultural resources.

ARTICLE 5

The Parties shall exchange, in accordance with the national laws, curriculum and research in the field of tourism, and encourage the exchange of experiences regarding the organization and management of the tourism business, and provide assistance to each other in training their-staffs in the field of tourism, based on a separate agreement between the authorized organs of the Parties.

ARTICLE 6

The authorized organs for the implementation of the present Agreement are:

from the Philippine side - the Department of Tourism of the Republic of the Philippines.

from the Kazakhstan side - the Agency of the Republic of Kazakhstan for Tourism and Sport;

In case of the change of the name or functions of the afore-named authorized organs, the Parties shall be informed through diplomatic channels in due time.

ARTICLE 7

Any modifications and additions can be made to the present Agreement by mutual consent of the Parties, which will be made out by separate protocols, which shall become integral parts of the present Agreement, and shall enter into force in accordance with Article 10 of the present Agreement.

ARTICLE 8

The present Agreement shall not affect the rights and obligations of the Parties arising from other international treaties to which one or both of the states are parties.

ARTICLE 9

In case of occurrence of disagreements in the interpretation or application of provisions of the present Agreement, the Parties will solve them by means of negotiations or consultations.

ARTICLE 10

The present Agreement is concluded for an unlimited period and shall come into force on the date of the last written notification reporting completion by the Parties of the internal procedures necessary for its enforcement.

Each Party may terminate the present Agreement by written notification to the other Party. The present Agreement shall terminate six (6) months from the date of sending by one of the Parties of such notification to the other Party.

The termination of this Agreement will not affect the implementation of the programmes that may have been formalized during its validity, unless the Parties shall agree otherwise.

Done at Manila on the 11th day of November 2003, in two original copies each in the Kazakh, English and Russian languages, and all texts are equally authentic. In case of divergence of interpretation of provisions of the present Agreement, the English text shall prevail.
