MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE KINGDOM OF BAHRAIN ON TECHNICAL EDUCATION

THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE KINGDOM OF BAHRAIN herein after referred to as the Participants;

Recognizing the mutual advantage in promoting and developing technical education cooperation;

Acknowledging the need to respond to the technological requirements for economic development;

Acknowledging that human resource development through technical education is a vital component for economic development;

Have reached the following understandings:

1. Scope of Cooperation

The Participants will develop, in accordance with their respective laws and regulations, technical education cooperation activities in the fields mutually agreed upon, such as but not limited to, human resource development, skills training, people exchange and technology transfer.

2. Modes of Cooperation

Technical education cooperation referred to in Paragraph 1 will be carried out through the following:

a) Joint conferences, symposia, workshops and exhibitions for students, workers, trainers and training center management

b) Joint research and technical studies in aid of implementing the identified cooperation areas

c) Joint training programs for workers, trainers and training center/school management

d) Professional exchanges in technical areas to allow the conduct of training programs, studies, observation and consultation

e) Exchange of professionals in the area of training center management

f) Exchange and dissemination of research studies, and other similar informative materials

g) Academic assistance for workers, students and teachers in the form of scholarships/fellowships

h) Exchange of technology packages between private enterprises and training institutions including all necessary assistance for the implementation of the technologies

i) Mutual recognition of skills and qualifications in areas to be identified and prioritized by the Participants

j) Such other forms of technical education cooperation as may be agreed by the Participants

3. Supplementary Agreements

This Memorandum contains the general provisions for technical education cooperation between the Participants. Supplementary memoranda defining the specific provisions for each area of cooperation will be developed by the Participants through the implementing government and private institutions.

4. Consultation

The Participants will meet as required and necessary to clarify the interpretation of this agreement, facilitate and coordinate the conduct of joint activities, and monitor the progress of the cooperative activities.

5. Financial Arrangements

The financial arrangements necessary to cover the expenses for the implementation of the cooperative activities under this Memorandum will be discussed and agreed upon by the Participants through the process of consultation. The sources of funds for the activities will be jointly determined by the Participants.

6. Administration

For the purpose of implementing this Memorandum, there will be designated a national coordinator and contact agency. The coordinator for the Republic of the Philippines will be the Technical Education and Skills Development Authority; the coordinator for the Kingdom of Bahrain will be the Ministry of Education (General and Technical Education).

7. Compliance with the Law

All activities resulting from this Memorandum will be carried out in accordance with the laws and regulations in force in the Republic of the Philippines and the Kingdom of Bahrain.

8. Revision and Amendment

Revisions to the provisions of this Memorandum may be requested by the Participants in writing. Any amendment will be done by mutual consent by both parties, and will enter into effect in accordance with the provisions of Paragraph 10.

9. Settlement of Disputes

Any dispute arising from the implementation of this Memorandum will be mutually settled by the Participants through consultations and negotiations without reference to any third party or tribunal.

10. Entry into Effect

This Memorandum will come into effect following the exchange of notifications by both Participants through diplomatic channels indicating their internal requirements, if any, for its entry into force have been complied with. It will remain in effect until such time as it is terminated by either Participant giving the other notice in writing, through diplomatic channels, of its intention to terminate the Memorandum at least six months prior to the intended date of termination.

The termination of this Memorandum will not affect any joint undertaking concluded or entered into during the term of the Memorandum, which will be fulfilled in accordance with the provision such agreement or undertaking.

INSTRUMENT OF RATIFICATION

TO ALL TO WHOM THESE PRESENTS SHALL COME, GREETINGS:

KNOW YE, that whereas, the Memorandum of Understanding Between the Government of the Republic of the Philippines and the Government of the Kingdom of Bahrain on Technical Education, was signed in Manama, Bahrain on 15 December 2003;

WHEREAS, the MOU, consisting of ten (10) articles, aims to develop technical education cooperation activities between the Participants;

WHEREAS, cooperation under the MOU shall include, among others, the fields of human resource development, skills training, people exchange and technology transfer;

WHEREAS, Article 10 of the MOU provides that it shall come into effect following the exchange of notifications by both Participants through diplomatic channels indicating their internal requirements, if any, for its entry into force have been complied with.

NOW, THEREFORE, be it known that I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, after having seen and considered the Memorandum of Understanding Between the Government of the Republic of the Philippines and the Government of the Kingdom of Bahrain on Technical Education, do hereby ratify and confirm the same and each and every Article and Clause thereof.

IN TESTIMONY WHEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
