MEMORANDUM OF AGREEMENT ON THE RECOGNITION OF TRAINING AND CERTIFICATION OF SEAFARERS BETWEEN THE COMMONWEALTH OF DOMINICA AS REPRESENTED BY THE OFFICE OF MARITIME AFFAIRS AND MARINE PERSONNEL AND THE REPUBLIC OF THE PHILIPPINES AS REPRESENTED BY THE MARITIME TRAINING COUNCIL

1. This agreement is made pursuant to paragraph 1.2 of Regulation I/10 of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended (the STCW Convention) and Section A-I/10 of the STCW Code between the Office of Maritime Affairs and Marine Personnel, hereinafter referred to as the Dominica Administration, and the Maritime Training Council, hereinafter referred to as the Philippines Administration.

2. It is agreed that the Dominica Administration shall recognize the certificates of competency issued by the Philippines Administration under the STCW Convention as amended in accordance with Regulation 1/10 of the said Convention subject to the terms and condition of this agreement.

3. All communications arising from this agreement shall be made to the persons named below:

The Dominica Administration and the Philippines Administration agree to give prompt notification of any changes in the above particulars.

4. The Philippines Administration agrees:

(a) to provide the Dominica Administration with details of the arrangements for the training and certification of seafarers in the Philippines as requested;

(b) to notify the Dominica Administration within thirty (30) days of any significant change in the arrangements for training and certification for seafarers in the Philippines;

(c) to make available for inspection its approved training courses, facilities and procedures by the. Dominica Administration;

(d) to respond promptly to requests for verification, of the authenticity and validity of the Philippine certificates from the Dominica Administration; and"

(e) to provide details of the quality standards evaluations conducted in accordance with Regulations 1/8 of the STCW Convention, on request.

5. The Dominica Administration agrees:

(a) to provide the Philippines Administration with the procedures to be followed in issuing an endorsement attesting the recognition of certificates; including that for the suspension or cancellation of any endorsement of recognition for disciplinary reasons;

(b) to provide the Philippines Administration with the details of the Commonwealth of Dominica legislation as required by officers in accordance with paragraph 2 of Regulation I/10 of the STCW Convention; and

(c) to promptly advise the Philippines Administration of the cancellation or suspension of any endorsement attesting the recognition of Philippine certificates, or the refusal to issue any endorsement of recognition.

6. This agreement may be terminated by the Commonwealth of Dominica without notice if at any time the Republic of the Philippines renounces the STCW Convention or fails to implement any amendment thereto.

7. This agreement may be terminated by either party giving not less than six (6) months notice in writing.

8. This agreement shall take effect on the date both Parties have indicated through diplomatic channels that the domestic requirements for its entry into force have been complied with. It shall remain valid for a period of five (5) years, and, shall be renewed automatically unless either party gives six (6) months notice before the expiration of this agreement.
