[ MEMORANDUM ORDER NO. 36, May 03, 2012 ]
REQUEST FOR THE CONCURRENCE OF THE PRESIDENT IN THE DEPUTATION OF THE ARMED FORCES OF THE PHILIPPINES (AFP) AND THE PHILIPPINE NATIONAL POLICE (PNP), FOR THE PURPOSE OF ENSURING FREE, ORDERLY, HONEST, PEACEFUL AND CREDIBLE CONDUCT OF THE SPECIAL BARANGAY AND SANGGUNIANG KABATAAN (SK) ELECTIONS IN BARANGAY LIPAT-ON, CALATRAVA, NEGROS OCCIDENTAL; BARANGAY TULAY, MADAMBA, LANAO DEL SUR; AND, BARANGAYS BIALAAN AND PATONG, BAYANG, LANAO DEL SUR
WHEREAS, the Commission on Elections (COMELEC), through its Resolution No. 9384 (s. 2012), resolved to request the concurrence of the President in the deputation of law enforcement agencies and other instrumentalities of the government, including the AFP and PNP, in connection with the 12 May 2012 special barangay and SK elections in Barangay Lipat-on, Calatrava, Negros Occidental; Barangay Tulay, Madamba, Lanao del Sur; and, Barangays Bialaan and Patong, Bayang, Lanao del Sur;
WHEREAS, COMELEC Resolution No. 9384 was issued pursuant to COMELEC Resolution dated 16 June 2011 declaring a failure of election at Barangay Lipat-on, Calatrava, Negros Occidental and declaring the proclamation of Ned Damondamon as Punong Barangay and all Kagawads of said barangay as null and void; COMELEC Resolution dated 27 December 2011 declaring a failure of election and ordering the conduct of a special election in Barangay Tulay, Madamba, Lanao del Sur; and, COMELEC Resolution dated 7 February 2012 declaring a failure of election in Barangays Bialaan and Patong, Bayang, Lanao del Sur, annulling the proclamation of the ostensible winners and ordering the conduct of a special election thereat, as clarified in COMELEC Minute Resolution No. 12-0313 dated 27 March 2012; and
WHEREAS, pursuant to Section 2 (4), Article IX-C of the Constitution, the COMELEC is empowered to deputize, with the concurrence of the President, law enforcement agencies and instrumentalities of the Government, including the AFP, for the exclusive purpose of ensuring free, orderly, honest, peaceful, and credible elections.
NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, hereby concur with COMELEC Resolution No. 9384 deputizing law enforcement agencies and instrumentalities of the Government, including the AFP and PNP, to assist the COMELEC in ensuring the free, orderly, honest, peaceful, and credible conduct of the 12 May 2012 special barangay and SK elections in Barangay Lipat-on, Calatrava, Negros Occidental; Barangay Tulay, Madamba, Lanao del Sur; and Barangays Bialaan and Patong, Bayang, Lanao del Sur.
The foregoing law enforcement agencies and other concerned agencies are hereby directed to coordinate and cooperate with the COMELEC in the performance of their duties and functions.
This Memorandum Order shall take effect immediately.
